Стаття присвячена аналізу окремих проблем правозастосування кримінально-правових норм в умовах воєнного стану в Україні відповідно до законодавчих змін, внесених до кримінального закону.Відзначається, що війна і збройний конфлікт суттєво змінюють узвичаєний властивий мирному часу порядок речей, видозмінює, а нерідко, породжує інші за своїм характером і сутністю відносини у суспільстві. Своєчасне правове їх регулювання обумовлюється пріоритетністю зміцнення обороноздатності держави, підтримання економічної системи і забезпечення роботи підприємств, відновлення зруйнованої інфраструктури, захисту цивільного населення, мінімізації катастрофічних наслідків війни. Характер і підвищена суспільна небезпека діянь, що вчиняються в умовах воєнного стану, вимагають додаткового кримінально-правового регулювання. Кримінальні правопорушення, які вчиняються під час війни, посягають на різні об'єкти кримінально-правової охорони, насамперед, державність, національну безпеку, територіальну цілісність. Звертається увага на те, що на тлі інтенсифікації законодавчих змін, що їх зазнав Кримінальний кодекс України, підвищується ризик недосконалого формулювання кримінально-правових норм, застосування яких може виявитися неефективним. З-поміж іншого наголошується, що дієвість кримінально-правових норм значною мірою залежить від бездоганності правничої термінології кримінального закону. Лінгвіністичні новації, якими законодавець прагне наповнити тезаурус кримінального права, нерідко ускладнюють практику правозастосування, породжують штучно конкурентність, а нерідко і колізійність кримінально-правових норм. На конкретних прикладах автор обґрунтовує необхідність дотримання принципів юридичної визначеності і законності кримінального законодавства. Підсумовуючи, автор зазначає, що зумовлена об'єктивними умовами динаміка удосконалення кримінального законодавства не повинна перетворитися на неконтрольований процес, що здатний призвести до викривлення дійсного змісту кримінально-правових засад. Тож кримінальна законотворчість за нинішніх умов має не тільки прагнути до новаційності, а й до збереження стабільності усталених кримінально-правових традицій. The purpose of the research is to highlight international cooperation in investigation of economic crimes of a transnational nature. The main content. It is emphasized that the concept of “international cooperation in fight against crimes” is in the sphere of action of various legal systems of both international public law and domestic law of states (countries) taking part in cooperation.”. It is established that it is necessary to clearly delineate the subject of international legal regulation of this type of interaction between states and international organizations. Methodology. Review of materials and methods based on analyzing documentary materials of international cooperation in investigating economic crimes of transnational nature. Conclusions. Due to objective reasons and circumstances modern international relations are characterized by expansion of legal cooperation in investigating economic crimes of transnational nature. At the same time, certain entities can be clearly distinguished in the circle of participants of such cooperation. Considering their goals of creation, their range of powers and features of their implementation such entities operate only in the fight against crimes at the international level - these are international law enforcement organizations.
The purpose of the research is financial and legal protection of land from being contaminated with hazardous substances (wastes) as a component of regional environmental policy. Main content. It is known that land contamination by industrial enterprises, through irrational use of agrochemicals and chemical plant protection agents lead to the accumulation of toxins, including heavy metals, pesticides, oil products, radionuclides. Therefore, one of the important factors of improving the legal protection of land, including protection from being contaminated with hazardous substances in Ukraine, consists in taking into account positive experience of those post-Soviet states that have a practical orientation in terms of legislation and achievements in law enforcement activities related to land protection. Methodology: The methodological basis of the research is presented as comparative-legal and systematic analysis, formal-legal method, interpretation method, hermeneutic method as well as methods of analysis and synthesis. Conclusions. The institution of legal land ownership in the post-Soviet Baltic states (Estonia, Lithuania, Latvia) and Georgia has been disclosed in detail. Justifiably, contamination is dangerous not only for life and health, but also for land resources in general.
