En Colombia, a diferencia de los regímenes de Estados Unidos y la Unión Europea, el examen de registro marcario y las decisiones de controversias administrativas y judiciales originadas en dicho examen carecen por regla general de soporte probatorio y se fundamentan en solitarias argumentaciones de aspectos que comprenden desde gramática, lingüística y fonética hasta conceptos de mercado. De esta manera, las decisiones de registrabilidad marcaria resultan arbitrarias e incoherentes, porque, en cada caso, el examinador, la autoridad administrativa o el juez se atribuye a sí mismo la función de consumidor medio, presunto comprador y público consumidor, dando por sentadas, sin pruebas, circunstancias que requieren apoyo de áreas del conocimiento ajenas al derecho. De tal manera que las autoridades deciden solo en nombre y por virtud de la potestad que ejercen, pero de acuerdo con su mera apreciación subjetiva, incumpliendo así los principios de necesidad y carga de la prueba. Este estudio presenta un análisis de derecho comparado que demuestra tal aseveración, expone conclusiones y recomendaciones.
