De forma tradicional, la relación entre el cuerpo y el derecho ha sido abordada desde la instancia positiva de la ley. En esa medida, el cuerpo se convierte en una superficie en la que se sancionan las verdades que evidencian el delito. Contrario a tal perspectiva, el presente artículo busca re pensar la importancia de ampliar el diálogo del derecho con otros saberes de tal manera que inaugure una forma reflexiva de interpretar su ejercicio e instaure una manera otra de estudiar el cuerpo y las complejidades que en torno al mismo se tejen.
El artículo realiza un acercamiento a la comprensión del concepto de interculturalidad en clave decolonial con base en los desarrollos que plantean distintos teóricos. Con el fin de desarrollar esta aproximación, en el primer apartado se toman como centro las reflexiones del profesor Oscar Andrés López, a partir del concepto de multiculturalismo. Esto sirve de entrada para el segundo momento, en el cual se aborda el concepto de interculturalidad en clave de la modernidad-colonialidad. Luego, se busca fundamentar una propuesta con el fin de comprender una acción intercultural y decolonial, para lo cual es necesario explicitar algunos de los planteamientos del filósofo mexicano Enrique Dussel con relación a la ética y la política de la liberación. Por tanto, este texto se estructura en dos partes que se dedican a dicha propuesta: en la primera se esbozan los rasgos de la ética de la liberación y, a continuación, se explicitan algunos planteamientos de la política. Se cierra con la descripción de lo que en este texto se denomina “la acción-política-decolonial-intercultural”
