As the procedure for the revision of the Brussels IIa Regulation is currently pending in the European Union, this paper focuses on the two issues which are correlated through the so-called “overriding rule” mechanism. The first problem concerns the proceeding on the return of the wrongfully removed or retained child involving two EU Member States – the State of refuge and the State where the child was habitually resident immediately before the abduction. The second one tackles the proceeding, currently regulated in the Brussels IIa, on the rights of custody (parental responsibility) when the return of the child was refused in the EU State on the grounds of Art. 13 of the Hague Child Abduction Convention. The proposals for the revision of the Brussels IIa Regulation heavily involve these issues. In that respect, the author indicates certain shortcomings and inconsistencies of the amendments proposed by the European Commission in the Proposal to Revise the Brussels IIa Regulation (2016) and the latest compromise solutions suggested by the Presidency to the Council in the General Approach to the Recast of Brussels IIa (2018). At the same time, the paper suggests two possible ways in which the balance between the principle of mutual trust between the EU Member States and the principle of the child's best interest could be better balanced. From the perspective of Private International Law of the Republic of Serbia, the revision of the Brussels IIa Regulation is important in view of Serbia’s candidate status for EU membership and the need to keep an eye on changes to the secondary EU legislation.
Глобализација и повећано кретање људи изазов су за међународно приватно право. Услед тога, ваљано правно уређење прекограничних случајева изискује већи степен међународне сарадње. У материји издржавања, ова потреба је довела до партнерства две светске организације које су се, свака на свој начин, бавиле наведеним питањем − Хашке конференције за међународно приватно право и Уједињених нација. Резултат те сарадње је Хашка конвенција о међународном остваривању издржавања деце и других чланова породице (2007) која замењује, у односима држава уговорница, Конвенцију Уједињених нација о остваривању алиментационих захтева у иностранству (1956). Имајући у виду да је Република Србија чланица само Конвенције УН, у раду се разматра потреба ратификације Хашке конвенције. Кључне речи: обавезе издржавања, Конвенција о остваривању алиментационих захтева у иностранству, Хашка конвенција о међународном остваривању издржавања деце и других чланова породице.
Predmet istraživanja rada jeste kritička analiza polivalentnosti stambenog prostora, kao i njegova primenljivost danas i ubuduće, kao odgovor na izazove koje postavlja brz razvoj i promena potreba ovdašnjih korisnika. Kao rezultat rada imamo uvid da celokupno stanje društva utiče i na nastanak i razvoj programa stanovanja i da oslikava i doba u kome nastaje. Novi oblici stanovanja i hibridne funkcije zahtevaju da budu smeštene unutar prostora koji mora biti dovoljno polivalentan da isprati njihove promene, pa projekat višeporodičnog stanovanja oslikava rezultat prethodno obavljenog istraživanja.
The prohibition of discrimination and the right of access to justice are guaranteed by several international treaties and the national legislation in force in the Republic of Serbia. In terms of Private International Law, it could be questioned whether the duty of foreign nationals to provide the security for costs (cautio judicatum solvi) when initiating a lawsuit still adequately protects the defendant. In that respect, the issue of possible breach of the Serbian Constitution by Article 82 of the 1982 PIL Act arises. Consequently, depending on the response to this issue, there is a general concern about the responsibility for discrimination, which calls for urgent amendment of the relevant provision stipulated in the 1982 PIL Act.
