The subject of this paper is discrimination, which essentially means any unequal treatment or unjustified making of a distinction based on personal characteristics of a particular person or group of people. In the introduction, the paper firstly analyzes the structure and significance of the prohibition of discrimination guaranteed by Article 14 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, and then specifically considers the practice of the European Court of Human Rights related to two (newer) selected judgments made following complaints against Serbia due to violation of the prohibition of discrimination based on disability.
In the case when the parent who does not exercise parental rights does not agree with the change of permanent residence of the child, i.e., doesn’t agree with the child moving abroad with a parent who independently exercises parental rights, courts in Serbia, as a rule, take the position that only because they did not give consent, the parent who does not exercise parental rights should be partially deprived of the parental rights and thus enable the other parent to independently decide on the change of permanent residence. In the theory of family law, this practice has been criticized as unacceptable, therefore there is a need to explore other procedural possibilities in such situations.
САЖЕТАК: У раду се најпре говори о усвајању Европске конвенције о људским правима и значају који има, а затим о њеном утицају на национално законодавство, посебно на Закон о парничном поступку. Предмет рада представља један од посебних разлога за понављање правоснажно окончаног поступка у парници. Према одредбама Закона о парничном поступку, пресуда Европског суда за људска права може бити основ за улагање овог ванредног правног лека. Ова могућност странки у поступку стоји на располагању, уколико је одлуком ЕСЉП утврђена повреда људског права, а иста може бити од утицаја на доношење повољније одлуке пред националним судовима. Domestic violence is a widespread and deeply rooted social problem. With the aim of stopping violence and preventing further manifestations of domestic violence, the Family Law prescribes protection measures, but also a special procedure for protection against domestic violence. The goal of this paper is to analyze some processual aspects of this procedure and the challenges that the courts are faced, especially as regards the beginning of the procedure, i.e. a legal nature of lawsuits for protection against domestic violence, a special urgency of the procedure and deviations from the principle of disposition, as well as the measures for protection against domestic violence and the criteria by which the court is guided in the procedure of their passing.
