An offshore installation is built or installed for the purposes of exploration and exploitation in any part of the sea. The offshore installations that are presently in existence reflect great scientific progress in the field of marine resources. However, they become a source of concern when they are no longer in use. Due to the potential to disrupt activities conducted around their location, they interfere with navigational safety. Therefore, it is important to remove such installations. Their removal should be based on the provisions of the IMO Guidelines and Standards. Indonesia is a coastal State and should adhere to the above mentioned guidelines and standard in designing policies and regulations.
The use of patient medical records for hospital payment claims is in essence contrary to the medical records confidentiality rules. This study aims to review the judicial use of medical records in the verification of health care financing in the era of national health insurance. This research uses descriptive study method with normative juridical approach. Qualitative data comes from literature review such as primary, secondary and tertiary law. This study indicates that verifiers with the status of health workers have the legal authority to use patient information in medical records as they relate to the profession. Medical secrets can be opened in the context of quality control and health care costs. Quality control through medical audit, and cost control with health service utilization. This study recommends that verifiers be selected from medical personnel and therefore have the authority to open a medical record.
Surat Kuasa Membebankan Hak Tanggungan pada dasarnya memiliki jangka waktu, yakni 1 (satu) bulan untuk tanah terdaftar dan 3 (tiga) bulan untuk tanah belum terdaftar. Jangka waktu tersebut dalam hal tertentu tidak cukup untuk dapat ditindaklanjuti dengan pembuatan Akta Pemberian Hak Tanggungan sehingga diperlukan pembaharuan Surat Kuasa Membebankan Hak Tanggungan. Namun dalam praktiknya, kendala yang dialami adalah ketidakhadiran debitor pada saat penandatanganan pembaharuan Surat Kuasa Membebankan Hak Tanggungan yang menyebabkan Surat Kuasa Membebankan Hak Tanggungan batal demi hukum. Metode penelitian yang digunakan adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa terdapat Surat Kuasa Membebankan Hak Tanggungan yang tidak dapat ditindaklanjuti dengan pembuatan Akta Pemberian Hak Tanggungan karena tidak dilaksanakannya pembaharuan Surat Kuasa Membebankan Hak Tanggungan sebagai ketidakhadiran debitor menyebabkan Surat Kuasa Membebankan Hak Tanggungan batal demi hukum sehingga kedudukan kreditor menjadi konkuren dan hanya berhak atas jaminan umum sebagaimana diatur dalam Pasal 1131 jo. Pasal 1132 Kitab Undang-Undang Hukum Perdata.
