Has the increased political influence of indigenous/peasant organizations on the local state in the Bolivian Andes helped them better address persistent poverty among the grassroots? The insights we gained in Northern Potosí show that there are two major movements with divergent political visions (framed around class or "peasantness"), and thus two long-term strategies for vivir bien. But both represent the same grassroots realities, and their communal leaders seek to apply similar practices (e.g. improving agricultural production or accessing off-farm employment in the mines of Mallku Khota). They also face the same difficulties-leading to complaints from their constituencies about the lack of actual support in the productive sphere. We find that this contradiction between political influence and grassroots criticism emerges less from the movements' ideological struggles over agrarian change, and more from everyday problems, including the difficulties their local representatives face as part of the complex local administrative system, the persistence of cumbersome bureaucratic procedures, and movements' obstructive practices of competition. Such mundane issues, we argue, are as important as issues of ideology in debates about agrarian/rural struggles.
Sin duda la aprobación y promulgación de la Constitución Política del Estado en el año 2009 de alcance Plurinacional y Comunitario, en Bolivia, marco el inicio del nuevo Constitucionalismo y este hecho histórico, jurídico, político, social y cultural tiene un alcance reparador, refundacional y representa la superación de las vertientes del Constitucionalismo liberal, del constitucionalismo social y el tránsito hacia el nuevo Constitucionalismo emergente de naturaleza Plurinacional, Comunitario e intercultural. La naturaleza reparadora y refundacional, se materializa también en el hecho de que, con el nuevo Constitucionalismo, se asume por vez primera en la vida republicana, los ejes transversales y fundantes del nuevo estado y sociedad plural y abigarrada; los ejes fundantes de la descolonización, del pluralismo y de la interculturalidad. En el presente texto el autor realiza el abordaje esencialmente desde la sociología y antropología jurídica, pero también desde la perspectiva de la filosofía y dogmática constitucional, este análisis contempla los siguientes contenidos: Los elementos fundantes del nuevo constitucionalismo boliviano, la materialización del Constitucionalismo Plurinacional, la reparación histórica y el reconocimiento de la existencia precolonial de las Naciones y Pueblos Indígena Originario Campesinos, la Descolonización como fundamento del nuevo estado, el Pluralismo jurídico y la Interculturalidad.
En el marco de la profunda transformación estatal que representa el nuevo constitucionalismo boliviano, se concreta el desarrollo normativo en el servicio notarial desde la puesta en vigencia de la Ley No 483 del notariado plurinacional concordante con los principios y fundamentos del nuevo constitucionalismo plurinacional comunitario, la Ley del notariado establece una nueva organización institucional del servicio notarial, redefine el perfil, las atribuciones y responsabilidades de la función notarial y sobre todo establece la aplicación del pluralismo jurídico igualitario y los mecanismos de cooperación y coordinación interjurisdiccional con los sistemas jurídicos indígena originario campesinos de las naciones y pueblos indígena originario campesinos. El presente artículo es parte de un estudio de caso titulado “El Servicio Notarial Plurinacional y el Sistema Jurídico Quechua de la Comunidad de Palca Mayu”. La problemática a la que se pretende esbozar algunas alternativas de solución tiene que ver con la ausencia de políticas y prácticas interculturales y de pluralismo igualitario que desde la mirada de los derechos de las naciones y pueblos indígena originario campesinos genera barreras, incomprensiones, discriminación, subalternizacion, desigualdad en el ejercicio pleno de los derechos y muchas veces también en el acceso al servicio notarial con calidad calidez y pertinencia. La metodología aplicada fue el estudio de caso con enfoque de la antropología jurídica, se logró establecer los alcances del sistema jurídico de los gobiernos comunitarios en los contextos de la nación quechua y la necesidad y pertinencia de plantear pautas de actuación notarial y los mecanismos de coordinación y cooperación con enfoque intercultural entre el servicio notarial y la jurisdicción indígena originaria campesina.
