Civil law plays an important social role, namely, the regulation of property and personal non-property relations, which all members of society are without exception. The Civil Code is often called the economic constitution of the state. Accordingly, the quality of civil law ultimately depends on the well-being of each individual. In addition, the improvement of the current legislation of Ukraine is a prerequisite for deepening the integration processes with the European Community. Thus, timely alignment of current legislation with current realities, part of which is the recoding of civil law, is certainly an important function of every state. The object of the study is the public relations that arise in connection with the recoding of civil law. The subject of the study was the normative acts of Ukraine, international normative acts, civil law doctrine. Scientific research methods such as analysis method, synthesis method, induction methods, and deduction method, and special-legal research methods, such as legal-dogmatic method and method of interpretation of legal norms, were used for the study. It can be conclude that Articles 387 and 391 of the Civil Code of Ukraine should be supplemented by the notions of the vindication and negatoria claims. In addition, there is a problem of competition vindication, restitution and condictia in Art. 1212 of the Civil Code of Ukraine. Secondly, the mechanism for transferring the rights and obligations of the buyer should be more explicit. Thirdly, there is a need to improve the statute of limitations according to the civil law of Ukraine.
У статті проводиться науково-теоретичний аналіз правового режиму винаходів, особливостей набуття (оформлення) патентних прав на винаходи, а також об’єм та зміст виключних патентних прав, що випливають з патенту на винаходи у зарубіжних країнах. Загальновизнано, що найбільш поширеним і значущим результатом науково-технічної творчості є винаходи, які мають високу соціальну і економічну значущість, що зумовило необхідність правового регулювання відносин, пов'язаних зі створенням, оформленням і використанням винаходів. Термін «винахід» в людській свідомості відображає реальність, яка існує незалежно від права, оскільки винахід є не правовою, а природно-технічної категорією і створення вина- ходів, а також їх використання не завжди було пов'язане з правовим регулюванням. Терміном «винахід» в технічній, філософської, художньої літератури позначають щось нове, оригінальне (нову технологію, конструкцію). У патентному праві цей термін має вужчий і певний зміст, тому в спеціальній літературі говорять про винахід в технічному сенсі і про винахід як об'єкт правової охорони. Звідси випливає, що особа, яка вважає себе винахідником, офіційно може бути визнана такою тільки в разі отримання патенту на винахід. Цей охоронний документ видається, якщо об'єкт, який просять визнати винаходом, відповідає критеріям для отримання патенту, встановленим законодавством. Набуття (оформлення) патентних прав на винахід вимагає проходження доволі складних формальностей Метою цієї статті є аналіз механізму правової охорони винаходів в зарубіжних країнах з урахуванням уніфікації міжнародного і європейського законодавства в сфері патентного права, а також розкриття особливостей процедури придбання (реєстрації) патентних прав на винаходи в зарубіжних країнах.
The European Court of Human Rights is increasingly focusing on the compatibility of tax law and intellectual property law with European standards of human rights and fundamental freedoms in the relationship between tax authorities and taxpayers. To increase the efficiency of the work of the bodies of the State Tax Service of Ukraine, as well as the judicial authorities of Ukraine and to ensure an adequate level of protection of the rights and interests of individuals and legal entities, it is important to analyze the ECtHR's practice of resolving royalties for the use of copyright objects. The research methodology consists of general theoretical and special scientific methods, namely: dialectical, historical, systemic, modeling and abstraction, induction, deduction, analysis, synthesis, comparative-legal method, and theoretical modeling. The study analyzes the ECtHR's practice of the settlement of disputes on royalty taxation for the use of copyright objects, clarifies the grounds and key positions of the European Court of Human Rights for resolving disputes related to royalty taxation, and reveals the value of the case-law of the European Court of Human Rights in the development of the tax system of Ukraine.
