Esta obra, que reúne un grupo de destacados académicos y profesionales, presenta reflexiones sobre distintos problemas jurídicos que, fruto de los cambios sociales y normativos, han desafiado al derecho de familia durante las últimas décadas. Dentro de este marco, el texto aborda, con una mirada práctica, analítica, crítica y reflexiva, asuntos relativos a la familia, los cuales son revisados desde ámbitos tan variados como la Constitución, el género, el derecho penal, el derecho de sucesiones, la seguridad social, la migración, la discapacidad y el régimen jurídico de los niños, niñas y adolescentes.
En este artículo se estudia la regulación que protege los derechos de niños, niñas y adolescentes frente a la publicidad en Colombia, a partir de su reconocimiento como sujetos de especial protección constitucional. Para ello, se utiliza el principio del interés superior del niño como guía para formular e interpretar las reglas sobre publicidad que afectan a este grupo poblacional; asimismo, señala obligaciones concretas tanto para el Estado como para el sector empresarial, con el fin de materializar la protección debida a cada uno de ellos.
This book seeks to deepen the principle of legal equality, its scope and content in front of certain population. In the same way as its extension to other subjects, under the methodology of legal dogmatics, it seeks a bibliographic and jurisprudential review within the project “The challenges of contemporary private law in the context of the constitutional debate and new developments in the economy”, of the Group Study in Private Law and Intellectual Property in the line of research Private Law. The foregoing within the framework of the constitutionalization of national private law, and comparative private law studies at the Catholic University of Colombia. The purpose of this book is to offer to the academic community states of the art that facilitate the subsequent formulation of research projects to allow the study, understanding and dimension of the subject of rights as a category that transcends the traditional concept of person in their search for legal equality in situations related to age, sex, gender, disability, economic conditions, and others. All within the era of the constitutionalization of private law.
En la presente ponencia se revisa la protección de los derechos de los niños, las niñas y los adolescentes en relación con la declaratoria de pandemia originada por el COVID-19. Así, se revisa esta incidencia como debilidad, oportunidad, amenaza y fortaleza. Como debilidad porque inicialmente las normas que ordenaron confinamientos nacionales no contemplaron grupos diferenciados. También puede verse como una oportunidad, pues al estar los padres en contacto por mucho más tiempo con los hijos se fomenta un ejercicio más consciente de la patria potestad, lo que permitiría construir su desarrollo de una forma más dialógica. Es una amenaza porque en muchos casos el confinamiento ha recrudecido las situaciones de violencia intrafamiliar y favorecido la deserción escolar, especialmente para aquellos niños, niñas y adolescentes que se encuentran en entornos más vulnerables. Finalmente, también puede observarse como una fortaleza, si se tiene en cuenta que el escenario de confinamiento social pone a prueba a cada país en relación con el cumplimiento y la efectividad de los derechos de la infancia y la adolescencia.
el propósito de este capítulo es presentar y valorar críticamente las fuentes normativas que, dentro del sistema jurídico colombiano, se refieren al manejo y uso de los datos personales de los niños, las niñas y los adolescentes. Para ello, el primer apartado presentará las normas que regulan el tratamiento de los datos personales de los niños, las niñas y los adolescentes en Colombia; el segundo estará dedicado a la jurisprudencia que ha tocado esta temática; el tercero se ocupará del habeas data de los niños, las niñas y los adolescentes en el ámbito de la administración pública; y el cuarto tratará la temática en los sistemas de protección universal y regional de derechos humanos.
