With billons of users, social media platforms (e.g. Facebook) are dominant players in a highly-concentrated online news market. They have great power over the distribution of information to their users, and over the organizations and individuals that produce it. Social media platforms use algorithms to perform functions traditionally belonging to news editors: deciding on the importance of news items and how they are disseminated. However, they do not acknowledge the role they play in informing the public as traditional news media always have and tend to ignore that they also act as publishers of news and the responsibilities associated with that role. This paper argues that it is essential for social media platforms to understand and embrace their role as both news publishers and distributors and highlights the essential responsibilities they must undertake so they can satisfy the information needs of their audiences and protect the public's right to information.Keywords: social media platforms; algorithms; news distribution; news publishing; duties and responsibilities; right to information. RESUMEN: Con miles de millones de usuarios, las redes sociales (ej. Facebook) son actores dominantes en un mercado de noticias online altamente concentrado. Ostentan gran poder sobre la información que distribuyen al usuario y sobre las organizaciones e individuos que la producen. Además, utilizan algoritmos para realizar funciones propias de los medios: deciden sobre la importancia de las noticias y como deben distribuirse. Sin embargo, no entienden adecuadamente su papel como informadores de la misma manera que lo hacen los medios tradicionales ni parecen querer reconocer que cumplen funciones propias de los editores de noticias, así como las responsabilidades propias de dicho papel. Este trabajo argumenta que es esencial que las redes sociales entiendan y acepten su rol como distribuidores y editores de noticias y resalta las responsabilidades esenciales que deben de asumir para satisfacer las necesidades informativas de sus audiencias y proteger el derecho a la información del público.Palabras clave: redes sociales; algoritmos; distribución de noticias; edición de noticias; responsabilidades y deberes; derecho a la información
The right to be forgotten has been widely discussed from a legal perspective. Courts have analyzed the existence and constitutional compatibility of the right in the national legal order of several jurisdictions around the world. However, even if the right to be forgotten is not a universally recognized right, by understanding how the law approaches tensions that arise between the right to freedom of expression and the rights to seek, impart and receive information, on one hand, and a right to be forgotten, underpinned by the rights to honor, privacy and personal data protection on the other, journalists can extract ethical guidelines that can orient them in the correct use of archival information about individuals to report on current events. This work begins by explaining how legal debates can help inform ethical discussions about journalism. Then, by exploring the legal development and justifications for the right to be forgotten and identifying key elements of this emerging right, we engage in a discussion around the use of archives and memory in journalism and then identify the elements that journalists should consider in relation to the use of archival information in their profession in a way that allows them to fulfill their journalistic duties without ignoring the legal context.
This paper analyzes the degree of compliance with advertising regulation related to content created by or aimed at underage people on YouTube. Research was done using content analysis on a sample of 463 videos that were published on the YouTube platform in the period from 2016 to 2020. Videos were selected from the channels of the 15 most popular children’s YouTubers, according to their position on the Social Blade Ranking, which originated from the United States, the United Kingdom, or Spain. The main objective of the study was to determine whether the videos disclose that they are about commercial content and whether this is done in accordance with laws in force. In addition, it was researched whether personal data were requested for promotional purposes. The article shows how despite the existence of advertising regulation in all of the researched countries, compliance is minimal regarding the identification of advertising content as such.
El fenómeno de los menores influyentes en las plataformas de vídeos experimenta un crecimiento imparable en el consumo, la actividad, la presencia de marcas alrededor de estos contenidos y la capacidad de influencia y transformación social de algunos contenidos. Todo ello también incrementa la problemática derivada, por ser un fenómeno parcialmente previsto en la normativa vigente. Existen nuevos y emergentes retos investigadores para el colectivo de los públicos involucrados: menores creadores de contenidos, padres, madres o tutores legales, profesionales del medio YouTube, seguidores, docentes e investigadores y sociedad en general. Ser youtuber es una de las cinco profesiones más deseadas por los niños españoles (Adecco, 2021). Inmersos en la cultura de la participación (Jenkins, 2006; Aparici y Osuna-Acedo, 2013), YouTube ofrece un espacio accesible donde almacenar estos contenidos y permite a los usuarios interactuar con ellos al buscar, compartir y comentar contenidos audiovisuales alrededor de los cuales dichos usuarios construyen comunidades. Los/as menores creadores expresan su identidad con vídeos que reflejan su forma de ver la vida e influyen en la comunidad de seguidores (Tur-Viñes, Nuñez- Gómez y González-Río, 2018). Este sociosistema se basa en contenidos audiovisuales con marcadas implicaciones para la publicidad y su regulación y autorregulación. El presente monográfico cumple el objetivo de acercarse al marco normativo y a las iniciativas de autorregulación sobre los menores creadores de contenidos, desde una perspectiva audiovisual, publicitaria y educomunicativa. Este fenómeno ha suscitado la necesidad de reformar normativas de la Unión Europea como la Directiva de Comercio Electrónico, la Directiva de Servicios de Medios Audiovisuales y el Reglamento de Protección de Datos (GDPR), de cambiar políticas en plataformas para ajustarlas a la normativa COPPA -en el caso de EEUU-y de redactar códigos de autorregulación por diversas entidades, muchas veces impulsadas por la interacción, o como resultado de, las acciones de entes regulatorios como la FTC en los Estados Unidos. En torno a dicho marco normativo, el presente monográfico aborda temas relacionados con la publicidad, la protección de los datos personales y de la privacidad y las responsabilidades de los diferentes sujetos que participan de esta realidad, así como el papel de las Administraciones y de los padres de los menores.
