Résumé La France vient de connaître un second mouvement de décentralisation après celui des années 1982-1983. En matière d’action sociale, il conforte les choix opérés antérieurement en confiant à la collectivité départementale l’essentiel des attributions, tant en ce qui concerne le pilotage des politiques que, pour une large part, leur mise en œuvre. Notamment, le département devient l’acteur central des politiques d’insertion des populations en difficulté. Cette logique ne manque pas de soulever des questions si l’on considère au fond que c’est l’essentiel des politiques publiques en direction des populations fragiles, précaires ou encore dépendantes et inadaptées qui sont renvoyées au niveau local alors que la régulation des activités économiques et la production des richesses sont du ressort de l’Etat et au-delà relèvent largement des instances européennes.
Benefit and welfare action laws tested against «decentralisation, act II ».
New decentralisation statutes enacted in 2003 are drawing a new portrait of welfare and benefits by promoting the department as the «leader » of the policy. The authors analyse the transfer of skills in terms of both content and consequences, of which there are many : legal consequences with the new definition of responsibilities, but also in terms of organisation given the transfer from national to departmental (i. e., local) services. Such consequences also lead to new positions being adopted by political authorities, as the department is promoted to a «welfare department » with ramifications at political, financial and philosophical level. The very definition of aid and welfare law is currently being tested.
Résumé Les associations ont toujours tenu un rôle important dans ce que l’on nomme aujourd’hui « l’action sociale ». Y ayant occupé presque tout le terrain avant que l’État commence à y intervenir, elles ont assuré pendant une longue période la majorité des interventions à destination des personnes handicapées, des personnes âgées ou encore de l’enfance en danger, ainsi que plus largement dans le vaste champ des personnes dites « en difficulté ». Constituant à la fois des opérateurs qui ont été progressivement inclus dans les politiques publiques d’assistance et des médiateurs concourant à exprimer et à construire les problèmes sociaux, elles doivent trouver un équilibre que les dernières évolutions du cadre réglementaire rendent de plus en plus problématique.
Alors que la collectivité départementale, constam-ment renforcée du point de vue de ses attributions notamment dans le champ des politiques sociales, pouvait apparaître comme un sorte de « département-providence » maîtrisant l’essentiel des politiques d’action sociale, elle se trouve en réalité fragilisée. Sur le plan institutionnel, l’émergence des intercommunalités, en particulier urbaines, et l’affirmation de l’échelon régional viennent à faire douter de la pertinence de ce niveau d’administration ; sur le plan fonctionnel, la conception de l’action sociale et la nature des dispositifs dont elle est l’héritière génère de graves difficultés financières qui pourraient bien constituer le symptôme d’une crise du modèle d’action sociale dont elle est porteuse.
Résumé L’environnement institutionnel du travail social est en constante mutation, comme l’attestent les nombreuses réformes législatives qui se succèdent à un rythme soutenu depuis une quinzaine d’années. Ces changements et adaptations tant des organisations et des administrations en charge de l’action sociale que des droits et des modes de prise en charge reconnus à ses bénéficiaires affectent profondément les cultures et les pratiques professionnelles du travail social.
