A have been reported to be associated with alcoholism.'+ Most of the data is indicative of slightly more right hemisphere dysfunction than left.5-' I Nonverbal deficits are reported to be more frequently reversible following abstinence in alcoholics than verbal Electroencephalographic studies converge in implicating the right hemisphere more than the left in brain electrical abnormalities in al~oholics.'~-'~ Few of the above reported studies however included considerations of the possible partial hereditary determination of the deficits observed. There is mounting evidence of strain differences in animal responses to alcohol.20.2' Electroencephalographic studies of young people at hgh familial risk for alcoholism have demonstrated abnormalities, primarily of the right h e m i~p h e r e .~~-~~ Neuropsychological, biochemical, genetic, and various clinical methods have also yielded evidence of at least occasional and partial hereditary determination in alcoh~lism.~~-~* Several of such studies reported more right than left cerebral a b n~r m a l i t y . '~~~ A limitation of the above studies was that the criterion for establishing familial risk for alcoholism usually consisted of determining the existence of one alcoholic biological parent. In the present study, an attempt was made to investigate individuals at very high familial risk for alcoholism. None of the studies reviewed included an evaluation of the interactions between familial risk, gender, and the experimentally manipulated consumption of alcohol in the determination of abnormal perceptual and cognitive performance.Affective disturbances are commonly reported in alcoholics. Alcoholic men tend to manifest childhood conduct disorder and/or hyperactivity, sociopathy, aggressiveness. criminality, and overt expression of anger.3'.32 Women alcoholics are more prone to monopolar affective disease, particularly depression.3s3s Several of these affectations are correlated with right hemisphere dysfunction and others with left hemisphere disorders.36 These findings have been replicated in male and female groups of individuals at high familial risk (HR) for alcoholism and in post hoc studies of the childhood of a l c o h o l i~s .~~-~~ Mood depression immediately following alcohol ingestion has been demonstrated experimentally in al~oholics.~' Such investigations have not as of yet however been carried out with HR subjects. Although a f f d v e and neuropsychological abnormalities have been reported in alcoholics and individuals at high familial risk for alcoholism, no systematic attempt has been made to investigate the most primary affective deficits as measured on neuropsychological performance tests.A visuospatial Facial Expression Test (FET) developed by Ekman and F r i e s e~~~~ has become the established neuropsychological test of affective performance in recent years. En este artículo hemos querido conocer mejor cuál es el punto de vista de los jueces canadienses con respecto al rol y al impacto de la declaración de las víctimas de actos criminales en el proceso decisional de la imposición de la pena. Estando cada vez más involucradas en el proceso, ¿ejercen las víctimas una influencia en materia deimposición de la pena ? ¿Contribuyen éstas al endurecimiento del régimen de penas en Canadá ? ¿Cuáles son las ventajas y desventajas que le atribuyen los jueces a este acercamiento victimario ? Dichos interrogantes han sido exploradas a través de entrevistas cualitativas llevadas a cabo con magistrados canadienses. Los resultados obtenidos parecieran indicar ciertos riesgos, pero de manera general han permitido concluir a favor de un proceso bien delimitado que no amenaza ni la independencia judicial ni las garantías jurídicas del acusado.
Cet article traite de la théorie des systèmes de Niklas Luhmann à partir de quatre concepts fondamentaux : communication, fonction, code et programme. Nous avons voulu spécifier les malentendus qui nuisent encore à l’exploitation du plein potentiel de chacun de ces concepts dans l’analyse empirique des systèmes sociaux de la société moderne. Nous avons par ailleurs porté une attention toute particulière à la question du changement et de l’évolution des systèmes, question souvent controversée dans l’analyse systémique. Le cas du système juridique sert d’arrière-plan à l’analyse proposée, mais nos observations restent pertinentes pour l’étude empirique de phénomènes se rapportant à d’autres systèmes sociaux fonctionnellement différenciés.

Au sud, en 1967, la President's Commission on Law and Enforcement and the Administration of Justice affirme que « la connaissance que nous avons [de ce phenomene] reste tres insuffisante »'. Dans cet article, nous nous appuyons sur une étude de cas, le cas du Comité canadien de la réforme pénale et correctionnelle (1969), pour penser théoriquement le rôle des commissions de réforme du droit par rapport aux conditions d’émergence des idées innovatrices en matière de justice pénale. Nos développements attribuent aux commissions de réforme du droit un rôle important dans l’institutionnalisation d’un système de pensée pouvant offrir une alternative à la rationalité pénale moderne.
In this article, we use a case-study on the Canadian Committee on penal and correctional reform (1969) to establish theoretical ideas regarding the role of law reform commissions in the process of creating cognitive innovation in the field of criminal law. We argue that law reform commissions can play a significant role in the process of institutionalising a system of thought that could offer an alternative to the actual modern penal rationality
