The paper addresses the fundamental aspects of transitional justice in Colombia, within the legal framework developed to obtain peace and considering the broad case law of the Colombian Constitutional Court on the matter. To this end, after laying down some foundations concerning the scope of the constitutional principle of “peace” in the Colombian legal order and the concepts of justice, truth, reparation and guarantee of non-repetition, the study focuses on the legislative and judicial developments that have characterized the process, starting from its very beginning up until the report of the Commission for the Clarification of the Truth in 2022.
RESUMEN.La ponencia investiga las posibles medidas de entender la relación entre, por un lado, la esfera del estudio del derecho y del razonamiento jurídico, y, por otro lado, la del estudio y del método científico. Al respecto, se propone una taxonomía teórica de los paradigmas en juego, indicando algunas de sus manifestaciones históricas.Se concluye que se puede hablar de "ciencia jurídica" cuando se presenten dos elementos característicos -la actitud objetivista y la apelación a una racionalidad pura y geométrica -y se argumenta que no es deseable renunciar enteramente a tal dimensión del discurso jurídico, aunque con algunas indispensables precauciones.ABSTRACT. The paper investigates the possible ways to understand the relation between, on one side, the area of legal study and legal reasoning and, on the other, the area of scientific study and method. At this regard, I propose a theoretical taxonomy of the paradigms at stake, indicating some of its historical manifestations. I conclude that we can speak of "legal science" when two characteristic elements occur -the objectivist attitude and the appeal to a pure and geometric rationality -and I argue that it is undesirable to entirely abandon such dimension of the legal discourse, although with some indispensable precautions. RESUMEN:La ponencia intenta describir, en sus aspectos esenciales, el estatuto subjetivo del concebido dentro del ordenamiento italiano. A través de una recapitulación de las pertinentes disposiciones normativas y de unos relevantes fallos jurisprudenciales, se concluye que el concebido, aunque no se pueda considerar a lleno título una "persona", constituye un buen ejemplo de los nuevos tipos de "sujetos" que caracterizan la juridicidad contemporánea. ABSTRACT:The paper tries to describe, in its fundamental elements, the subjective status of the unborn under the Italian legal order. After a review of the applicable norms and some relevant judgments, the conclusion is that the unborn cannot be considered a "person" in all senses but, still, constitutes a good examples of the new "subjects" that characterize today's law. This paper deals with a peculiar doctrine of the Italian Constitutional Court, the “prohibition of legislative automatisms,” which is used, in some judgments, in an internationally oriented form. My argument is that this doctrine can be seen as an effective legal and constitutional instrument operating in the “multi-level” scenario and namely in the framework of international systems and treaties of human rights protection. Indeed, it provides a good degree of flexibility and a good balancing point between international integration and national autonomy in light of the need to reach an adequate and “fair” solution in the concrete case and, therefore, in favour of the enhancement of human rights protection at the practical level.
