RESUMOPartindo-se da percepção de que a natureza é também um produto humano, o cenário de crise (degradação ecológica) originou-se com a Revolução Industrial, que de maneira desordenada culminou numa crise ambiental global a partir de um modelo de civilização que mantém uma relação insustentável com os recursos naturais existentes no Planeta Terra. Dado o enfoque ao colapso ambiental ameaçador da geração presente e futura, tem-se a necessidade de adoção de mecanismos emergenciais, para além das normas jurídicas, com o escopo prioritário de se efetivar o Estado Socioambiental de Direito contemporâneo, perspectiva de transformação da sociedade atual que altera a sua relação paradigmática com a natureza. Dessa forma, busca-se tecer algumas considerações acerca do modo como se apresenta os valores da sociedade capitalista neste contexto, em que o mito do desenvolvimento a qualquer custo reduzido a mero crescimento econômico não pode mais prosperar.

This article aims to present, from a historical perspective, the main legal instruments on access to land, based on authors who have studied the agrarian issue in Brazil, namely: João Pedro Stédile (2011), José de Souza Martins (1980), Marcia Maria Mendes Motta (1998), Maria Ligia Osório Silva (1996, 1997), Ruy Cirne Lima (1954), among others. It also aims to demonstrate how legislation has advanced in the process of recognizing the socio-environmental function of property while it brought ambiguities that have led to regression in terms of a fairer and more equitable distribution of land, essential to human needs, such as housing and food. The materials used to prepare the article came from primary and secondary sources collected through bibliographic and documentary research.KEYWORDS: property of land, socio-environmental function of property, Brazilian legislation.
Le rôle de la Responsabilité Sociétale des Entreprises - RSE n’est plus à démontrer aujourd’hui tant les entreprises responsables font partie du paysage économique. Pourtant cette notion, portée par les Nations-Unies à l’occasion du Global Compact de 1999 n’a pas toujours rencontré le succès escompté. L’Union Européenne a joué un rôle important en la matière, comme la France qui dès 2002 a légiféré en la matière. Si la RSE s’est peu à peu institutionnalisée et s’est finalement frayée un chemin dans l’évolution réglementaire du droit des affaires s’est incontestablement parce que le monde des affaires a besoin d’éthique, de transparence, de confiance. La méthodologie de recherche, utilisée dans cet article, est exploratoire et repose sur l’analyse de références d’articles et d’études bibliographiques.
