O Decreto-Lei nº 7.661/45 foi até 2005, quando houve a edição da Lei nº 11.101/05, o dispositivo que regulou o direito falimentar brasileiro. No ano de 2020 houve uma nova alteração através da Lei nº 14.112/20 que revogou alguns artigos da Lei 11.101/05 e adicionou novos. Os três dispositivos históricos criaram o arcabouço jurídico sobre o tema, com seus lados positivos e negativos. A questão que será debatida no presente trabalho é: ao longo do tempo, o direito falimentar brasileiro conseguiu equilibrar o poder dos detentores de grandes créditos e a proteção aos pequenos credores nas recuperações judiciais e falências? O objetivo do artigo é, portanto, discutir se efetivamente nos dias atuais existe o equilíbrio entre o poder dos grandes credores e a proteção aos detentores de menores créditos e se este cenário precisa ser modificado de alguma forma. Para tanto, foi feito uso de pesquisa teórica e descritiva, desenvolvida por meio de revisão bibliográfica e análise documental, notadamente o Decreto-Lei nº 7.661/45, a Lei nº 11.101/05 e a Lei nº 14.112/20, de maneira a viabilizar a percepção da evolução legislativa sobre o tema no decurso do tempo. Ao se efetuar a pesquisa nos diferentes dispositivos que regularam o direito brasileiro, torna-se perceptível a necessidade de se adequar melhor as normas de forma a proteger efetivamente os detentores de menores créditos, pois esta matéria foi em grande parte ignorada ao longo da história jurídica nacional.
