Este artigo perpassa a construção social do ensino superior no Brasil entre 1889 e 2018. O texto parte de uma reflexão que associa diferentes conjunturas com as respectivas concepções prevalecentes sobre o papel do ensino superior, ensaiando um amplo resgate que vai das suas origens, no século XIX, até os dias atuais. A pesquisa bibliográfica, amparada em uma metodologia socio-histórica, termina debatendo os desafios atuais que se apresentam para o ensino superior no Brasil, no contexto de um governo originalmente transitório e claramente descomprometido com as camadas populares ou com a democratização da educação.
Esse pequeno ensaio é fruto de uma vontade de discutir o direito além da normatividade ou das produções estritamente jurídicas, partindo-se da pergunta segundo a qual “por que não pensar a História do Direito Moderno – a gênese da retórica jurídica da modernidade – a partir da literatura, da ciência política e da economia?”. Sem grandes pretensões, propõe-se ao leitor usar olhos de Historiador das Ideias e contemplar o Direito e ousar dizer que entre termos e temas aparentemente tão diferentes há intercessões. Elas seriam o próprio Direito, mas também a vontade de conectá-lo ao que surge a partir do fim da Idade Moderna: Individualismo, Liberalismo, Autonomia da Vontade etc. Essa seria uma interessante de forma a abordar a gênese de um novo momento na história ocidental em que novas regras, novas ideologias, novas percepções da ação humana e novas crenças apareceram pari passu, juntando o Direito, a Literatura, Religião, as formas do pensar e as instituições. Trata-se de oferecer ao leitor a possibilidade de desnudar os mitos em torno da dogmática jurídica juntando-os aos demais mitos em torno da ratio humana.
