Les codes de conduite sont l’instrument privilégié par les entreprises multinationales pour publiciser leurs engagements en matière de responsabilité sociale et environnementale. Les organisations syndicales internationales considèrent, pour leur part, que les accords cadres internationaux offrent de meilleures garanties que les codes de conduite au chapitre de la protection des droits sociaux et humains des travailleurs employés par des entreprises multinationales et de leurs partenaires d’affaires à l’échelle mondiale. Ces accords négociés entre des entreprises multinationales et des Fédérations Syndicales Internationales (FSI) ont enregistré une croissance importante au cours de la dernière décennie, et sont considérés par ces dernières comme un champ d’intervention prioritaire à l’ère de la mondialisation. Cet article examine, à travers une comparaison du contenu, de l’application et des effets des codes de conduite et des accords cadres internationaux, leur contribution respective à la responsabilité sociale des entreprises multinationales. Il ressort de cette comparaison que les accords cadres internationaux font une plus grande place aux droits fondamentaux du travail et comportent des procédures de suivi plus contraignantes que les codes de conduite qui servent à promouvoir l’image de marque des entreprises multinationales.
This article emphasizes the contribution of International FrameworkAgreements (IFAs) to collective bargaining within multinational companies(MNC). For this purpose, we used various data, including content analysis of 42IFAs and interviews with representatives of the five Global Union Federations(GUFs) involved in the negotiation of these IFAs, in order to assess the contentand efficiency of these agreements. Our analysis reveals that IFAs usuallyinclude a commitment by the signatory MNC to conform to ILO’s coreconventions in all its operations, and toinform its business partners of theirobligations under the agreement. Regular meetings are held with unions’representatives for the monitoring of these agreements to ensure their respect bythe signatory multinational companies andtheir business partners. According toGUFs’ representatives, the IFAs have been effective in protecting basic tradeunion rights covered by ILO conventions 87 and 98. In the last part, weemphasize the IFAs’ contribution to collective bargaining within MNCs anddiscuss the prospects for future development of international collectivebargaining, particularly in light of Levinson’s seminal work (1972) on thissubject.
