Após a promulgação da Lei 13.257 (2016), cunhada como Marco Legal da Primeira Infância, concebeu-se a possibilidade de conversão da prisão preventiva em prisão domiciliar para mulheres grávidas ou com filhos de até 12 anos incompletos. Destarte, este artigo teve como objetivo analisar, à luz da Criminologia negra e feminista, de que maneira o Judiciário paraibano tem se pronunciado a respeito da concessão da medida cautelar domiciliar para estas mulheres. Para tanto, a metodologia adotada foi a pesquisa documental, de abordagem qualitativa, sendo analisadas as decisões em sede de habeas corpus da Câmara Criminal do Tribunal de Justiça da Paraíba entre 2018 e 2019. Foram examinados 57 julgados que negaram o pedido de conversão da preventiva em domiciliar, sendo analisado o discurso jurídico em torno da mulher que teria cometido o delito. Constatou-se que a fundamentação utilizada se assenta, com frequência, em um discurso moral sobre a mulher. Ainda, vislumbra-se que a medida cautelar domiciliar é necessária e importante como política desencarceradora e para a manutenção dos vínculos maternos, mas que se trata de mais uma medida privativa de liberdade. Portanto, entende-se que se deve ter como horizonte uma sociedade em que nenhuma mulher precise estar encarcerada.
Este artigo tem como objetivo refletir sobre a Política Criminal no contexto do Neoliberalismo, a partir dos preceitos da Criminologia Crítica de inspiração marxista, realizando uma breve análise sobre a realidade brasileira. Trata-se de um estudo teórico de revisão bibliográfica, que tece análises sobre a configuração da agenda neoliberal no Brasil e, em seguida, busca compreender de que maneira a Política Criminal assume centralidade nesta agenda, respondendo à demanda de controle social a partir do disciplinamento da classe trabalhadora e da penalização da pobreza como resposta à desigualdade e à exclusão social.
RESUMO O Movimento Higienista teve grande impacto nas políticas públicas brasileiras do final do século XIX e início do século XX, dando destaque à proteção e cuidados com a infância. Tal preocupação, influenciada diretamente por aportes teóricos oriundos da Europa, teve em Carlos Arthur Moncorvo Filho um de seus principais representantes no país. O objetivo deste artigo é analisar algumas histórias do Instituto de Proteção e Assistência à Infância (IPAI) e dos anexos criados junto a ele, idealizados pelo próprio Moncorvo Filho. Ao longo das análises, pôde-se perceber o quanto discursos e práticas de proteção à infância carregavam em si estratégias de normatização de condutas e moralização social. Retomar algumas histórias ligadas à preservação da infância no Brasil é de grande importância para a Psicologia e demais Ciências Humanas e Sociais. Tal estratégia tende a possibilitar aos especialistas de hoje refletir sobre a prática profissional e avaliar que modelos estão sendo produzidos ou reproduzidos nestas práticas. Palavras-Chave: Infância, Proteção, Moncorvo Filho, Higienismo ABSCTRACT The Hygienist's Movement had a big impact on Brazilian public policy at the end of XIX century and beginning of XX century, shedding light on child's protection and care. That question was directly influenced by European theories. Carlos Arthur Moncorvo Filho was a major representative in the country. This paper aims at analyzing some stories that happened at the Institute for the Preservation and Assistence of Children and its extensions. The medical doctor Moncorvo Filho founded these clinics. Through analyses, it is possible to notice that discourse and practices toward children's protection carry strategy and standardize behavior and social moral. Retelling some stories linked to childhood preservation in Brazil is vital to psychology and others human and social sciences. Such a strategy enables specialists at present to reflect upon professional practices and to evaluate models that have been produced or copied in these practices.
