Bilimsel çalışmaların özgünlüğü temel olarak etik kurallara riayetle sağlanabilmektedir. Bu kuralların başında ise intihal yasağı gelir. İntihal yasağının herhangi bir fikrin, ortaya atıldığı ilk eser ile irtibatının korunmasına yönelik mahiyette olduğu söylenebilir. Yazarın bilerek ya da bilmeyerek başkalarına ya da kendisine ait mevcut eserlerden aşırma yaparak oluşturduğu eserin, intihalin tespitiyle birlikte bilimsel bir geçerliliğinin bulunmadığı ortaya çıkmaktadır. Esere ilişkin bilimsel alandaki yaptırımın yanında intihalin, fail açısından birtakım hukuki sonuçları da bulunmaktadır. Bu çerçevede kanun koyucu tarafından idari ve cezai yargılama öngörülmüştür. Genellikle göz ardı edilmesi nedeniyle intihale ilişkin Fikir ve Sanat Eserleri Kanunu’ndaki cezai hüküm ile Türk Ceza Kanunu’nun ilgili maddelerinin karşılaştırmalı olarak değerlendirilmesi, makalenin odak noktasını oluşturmaktadır. Çalışmada özellikle intihal barındıran eser üzerinden sağlanan fayda ile uğranan zararın, söz konusu iki kanuna başvuru noktasındaki önemi analiz edilmiştir. Zira akademik unvana ve dolayısıyla bu unvan karşılığındaki kadro ve ücretlere hak kazanılmasında dikkate alınmaları nedeniyle bilimsel çalışmalarda yapılan intihaller neticesinde haksız menfaat ve -başta kamu zararı olmak üzere- zarar oluşmaktadır. Ayrıca Türk Ceza Kanunu kapsamındaki dolandırıcılık ile nitelikli dolandırıcılık arasındaki ayrım gözetilerek intihal eylemiyle bu iki suçtan hangisinin unsurlarının gerçekleştiği değerlendirilmiştir. Çalışmada son olarak intihal eylemine iştirak hâlinde uygulanabilecek cezai müeyyideler de değerlendirme konusu yapılmıştır.
