Este artículo forma parte de una investigación cualitativa sobre el mapa de situación del trabajo social judicial. Una profesión con treinta años de vida en España y que se encuentra en revisión como todas las disciplinas y discursos en tiempos de crisis. Los relatos de los profesionales han dibujado una cartografía del trabajo social judicial dentro del equipo psicosocial que a su vez se sitúa dentro de los juzgados de familia.
Los Juzgados de Familia de Madrid y Barcelona disponen de trabajadores sociales para ayudar al juez en las decisiones sobre asuntos de familia. Estos profesionales cumplen su función en el SATAF (Servei d'Assesorament Técnic en l'Ámbit de Familia) en Barcelona y los equipos psicosociales en Madrid. Este estudio busca develar una situación real escondida en polémicas y debates científicos y populares. El estudio busca también conocer cómo se sitúa el trabajador social del ámbito de justicia. rEsUMEnLos equipos psicosociales de la administración de justicia desde 1982 asesoran a los jueces en materia de conflictos familiares. El estudio que se preesenta informa cómo se ha elaborado el discurso de este colectivo, y parte de la noción de discurso de Michel Foucault, desde su visión problemática. Luego recoge, a través de entrevistas y grupos de discusión, las opiniones de los trabajadores sociales y psicólogos de Madrid y Barcelona sobre la gestión del discurso. El estudio plantea un supuesto inicial sobre un menor protagonismo de los trabajadores sociales en la creación del relato que corresponde a una práctica común y busca una explicación y una descripción de lo sucedido.El trabajo que se presenta forma parte de una investigación académica básica y exploratoria de tipo cualitativo, basada en el principio fundamen tal de obtener los discursos principales para la resolución de los objetivos planteados como nuevas alternativas técnicas del trabajo psicosocial en los juzgados de familia y las tareas que desarrollarán los equipos psicosociales con las familias.Como conclusiones cabe resaltar que los trabajadores sociales forenses ven el futuro con optimismo, valoran su propia intervención en la ayuda a los jueces y creen que habría que impulsar una actuación profesional más propia. Los psicólogos y trabajadores sociales forenses entienden que hay un problema de falta de discurso psicosocial, por lo que es necesaria una mayor implicación en producir investigación en el área del discurso psicosocial. Los profesionales de los juzgados de familia entre los que se encuentran jueces y trabajadores sociales actúan en las familias en las que aparecen diferentes relaciones interpersonales conflictivas. Estos profesionales abordan la violencia de género, la custodia compartida y la mediación familiar en su práctica profesional diaria. Este artículo, basado en una investigación doctoral más amplia sobre el trabajo social judicial como ayuda en las crisis conyugales analiza cualitativamente los discursos obtenidos en entrevistas realizadas a jueces y trabajadores sociales de los juzgados de familia de Madrid y Barcelona. Se reflejan las opiniones más comunes de la actuación pericial y judicial, realizando una prospección anónima para alcanzar la expresión libre de los profesionales. Los significativos resultados que se ofrecen indican la necesidad de continuar estudiando las problemáticas abordadas en los juzgados de familia, en lugar de profundizar en una polarización del pensamiento sobre cuestiones trascendentales para la organización de las familias en crisis.

FORENSIC SOCIAL WORKThis paper will cover the state of affairs in Spain, and will give a brief comparison with the state of affairs of this professional specialty in Great Britain, the United States and Argentina.In Spain, Law 7/81, 7th of July, which was modified by the Civil Code, contained the provisional and circumstantial terms about the lives of couples and the terms which marriages should be subject to in order to agree on a divorce. The legal possibility of a marital breakdown caused the formation of the first Family Courts (by Royal Decree 1322-81 on the 3rd of July) in different Spanish cities, and in 1983 they were equipped with psychosocial teams.In 1983, the professional career in the field of administration of justice for social workers began in the family courts when a social worker and a psychologist formed and set up two expert teams.The role of the social worker in the administration of justice was consolidated after the call for official selective From this moment on, the different administrations have gone on to create forensic social worker positions as public servants of the Ministry of Justice or for the autonomous communities with the competencies to administer justice in their territory (Gomez & Soto 2015b). The professionals would be subject to the authority of these institutions and the relevant judges in the family proceedings. These social workers have the role of assisting the judges in any family law proceedings by providing recommendations through a report which follows the format of expert evidence, also called a specialist´s report. Therefore, we can talk about professionals who are civil servants (Gómez & Herrador, 2009) who depend on the public administrations, either from the central or regional governments, but who respond to the judges´ request for advice in family law proceedings. This is the situation of this profession and specialty in Spain, but it is worth comparing this reality with the way forensic social work is organized in other countries as well.In Great Britain, legal proceedings are regulated by the Children Act of 1989 in England and Wales; in Northern Ireland, the law (Children NI Order 1995) is narrowly based on the Children Act of 1989.All the cases in relation to the custody and access to children are dealt with by adhering to the legislation mentioned above. Parents can appeal to the courts in an effort to resolve an issue of dispute. Initially, the court together with the legal team will work to resolve any difficulties as much as possible and/or aim to negotiate an agreement. If this is impossible, the court will send a social worker to mediate, evaluate and recommend a possible resolution.In England and Wales, the tribunal refers the case to an independent organization called Children and Family Court
