The reforms that have occurred in Indonesia have changed the joints of the life of the nation and state. One of them is changing the centralistic system of government. The demand for reforms related to the broadest possible implementation of regional autonomy is the beginning of the implementation of the decentralization principle in Indonesia. This principle can be reflected in the presence of the Special Autonomy policy, one of which is in Papua Province. This research uses a normative legal research method with a statutory approach. The results of this research show that the stipulation of special autonomy status for Papua Province is legally based on Law Number 21 of 2001 concerning Special Autonomy for Papua Province. This law is an attempt by the central government to develop Papua to be the same as other regions. There are many specializations and special rights that the Papuan people have obtained through the determination of this status, but they are still not being implemented in real terms in the field. This is due to government inconsistencies, especially when viewed from a good governance perspective. Good governance in the principle of participation in Papua has not been implemented properly because of the existence of considerable power as a cultural representation which has not fully represented the Papuan people so that many rights and opinions and voices of the Papuan people have not been implemented.
Perlindungan bagi pekerja Migran Indonesia masih membutuhkan perhatian lebih, banyak tenaga kerja migran Indonesia kerap mendapatkan perlakukan yang kurang layak dan diantaranya terjerat beberapa kasus sehingga terancam hukuman mati bahkan telah ada yang di vonis. Pada tahun 2018 dengan diterbitkannya Peraturan Menteri Ketenagakerjaan Nomor 18 Tahun 2018 tentang Jaminan Sosial Pekerja Migran Indonesia merupakan salah satu upaya untuk memberikan perlindungan sosial ataupun jaminan sosial kepada seluruh pekerja migran Indonesia serta bertujuan untuk meminimalisir adanya permasalahan yang didapat oleh para pekerja migran Indonesia. Penelitian ini bertujuan untuk mengetahui efektivitas kebijakan pemerintah terkait jaminan sosial pekerja migran Indonesia. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan yuridis empiris. pengumpulan data dalam penelitian ini dilakukan dengan cara wawancara serta pengumpulan data statistik terkait pokok permasalahan yang dibahas. Data Hasil dari penelitian ini menyimpulkan bahwa kebijakan pemerintah terkait jaminan sosial pekerja migran indonesia cukup efektif untuk dapat memberikan perlindungan dan kesejahteraan kepada para pekerja migran Indonesia.
Maraknya sistem belanja Cash On Delivery (COD) di masyarakat sehingga perlu untuk disampaikan kepada pembaca mengenai bagaimana sesungguhnya pengaturan terkait hal tersebut baik menurut UU Perlindungan Konsumen maupun UU Informasi dan Transaksi ELektronik (ITE). Penilitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan undang-undang, buku, dan internet yang berkaitan dengan masalah yang diteliti. Penelitian ini disusun dengan mengacu kepada dua sumber data yaitu data primer dan data sekunder. Sumber data primer berupa landasan hukum negara yaitu KUHP perdata, UU No 8 Tahun 1999 Tentang Perlindungan Konsumen dan UU No 11 Tahun 2008 Tentang Penerjemahan Informasi dan Komunikasi Elektronik. Sedangkan data sekunder bersumber dari dokumentasi pada dokumen yang relevan dan berhubungan dengan pembahasan penelitian. Hasil penelitian menyatakan bahwa UU no. 8 tahun 1999 mengatur hak dan kewajiban dari masing-masing pembeli maupun penjual. Dalam pembelian COD pelaku usaha wajib memenuhi kewajibannya dengan memberikannya barang sesuai dengan deskripsi yang disebutkan dan harga yang dibayarkan. Jika tidak pesanan yang dikirim tidak sesuai dengan kedua hal tersebut penjual diwajibkan untuk memberikan kompensasi atau ganti rugi terhadap kerugian yang dihadapi oleh konsumen. Kasus pembatalan sepihak jika dibahas dalam UU Perlindungan Konsumen termasuk ke dalam kewajibam konsumen untuk beritikad baik dalam melakukan transaksi pembelian. Dalam UU ITE Jika terjadi pelanggaran hak dan kewajiban yang dilakukan oleh penjual dan merugikan pembeli dapat diselesaikan dengan tiga cara yaitu negosiasi atau mediasi, penyelesaian melalui badan penyelesaian konsumen dan melalui pengadilan.
Internet is one of the media facilities that is not only used for communication, but is also used in the process of buying and selling or trading (e-commerce). Behind all the conveniences obtained, e-commerce also raises the issue of consumer concerns on the responsibility for personal data. This study aimed to examine and reexplain the urgency of protecting personal data of e-commerce consumers and focused on the challenges and legal certainty of protecting personal data of e-commerce consumers in Indonesia. The method used was a doctrinal research method. This study showed that the application of data in e-commerce provides many benefits. However, the challenge was the absence of binding laws to safeguard personal data submitted to ecommerce companies. Legal certainty for the protection of e-commerce consumers is currently contained in several laws and regulations. Therefore, it is necessary to improve the effectiveness in the implementation of personal data protection and to regulate the protection of personal data in a law. In Indonesia, the urgency of the ratification of the Personal Data Protection Bill may become a solution in providing legal certainty for the protection of e-commerce consumers on their personal data.
Based on the history before the reform era, there have been many cases of government committing corruption, collusion and nepotism, this is the background of the movement to create a government to run good governance. As time has progressed, the time has come for a time that is all full of digitalization, both in the economy, education and politics. This research uses normative legal research methods. This study shows that the government in running its government will also be based on the development of sophisticated information technology which can be called E-Government. Therefore, there is now a time when the Indonesian government has used and allowed the Online Single Submission (OSS) system to make it easier for people who want to take care of business licensing. The implementation of good governance during the Industry 4.0 Revolution can take advantage of science, technology and information to provide good facilities and services to the Indonesian people, and the public can easily access government information.
