Se evidencia la problemática del abuso sexual con NNA en Colombia, ante las constantes cifras de conductas punibles de tipo sexual en contra de NNA, problemática que se teoriza, y se encuentra relacionada con el modelo de paradigma operante en Colombia el populismo mediático y punitivo, por ultimo a partir de cifras del sistema de justicia y el sistema penitenciario, se recomienda el enfoque de las políticas publicas en los fines de la pena, especialmente la prevención, en contraposición a la creación y aumento de penas.
<p>El objeto de estudio de este escrito es el descubrimiento de la prueba en los procesos penales, en especial con relación a los deberes de los acusadores en Colombia en la obtención de evidencia que pueda ser considerada razonablemente capaz de debilitar a la acusación o fortalecer a la defensa y que esté en manos de terceros. Con tal fin se hace un estudio de derecho comparado del descubrimiento de la prueba en los procesos penal colombiano e inglés.</p>
Cada cierto tiempo se da cubrimiento noticioso excesivo a un delito sexual y violento en contra de un menor de edad que produce un fuerte rechazo social y que genera propuestas de reforma normativa de ampliación del campo de acción del Derecho penal por parte de diversos agentes sociales.
