This article explores how the Roman Catholic Church in France re-evaluated its traditional condemnation of conscientious objection in the closing years of the Algerian War. In contrast to the French Protestant Churches after 1948, the Catholic Church continued to proclaim objection to be detrimental to the principles of state sovereignty and obedience to legitimate authority. Despite this, cases of Catholic conscientious objectors like Jean le Meur and Jean Pezet brought contentious Church debates into the public sphere, dramatized in the press and the courtroom. The article traces how the moral dilemmas of the Algerian War created a space for new theological ideas that challenged the hierarchical, corporatist structure of the French Catholic Church and opened the way for a new emphasis on individual conscience that came to fruition with Vatican II. By focusing on Catholic activism during the war itself, the article also challenges the idea that support for conscientious objection emerged spontaneously after the end of the Algerian War. More broadly, the article addresses the wider narrative of the emergence of human rights by illustrating how the Algerian War proved to be a turning point in the relationship between individuals and authority.
On 3 October 2020 Pope Francis issued his third encyclical, Fratelli Tutti. Signed in the symbolic location of Assisi, home of St Francis, the encyclical represented the pope's response to the fears and anxieties wrought by the COVID-19 pandemic, as well as the burning injustices of racism, global inequality and climate change. The encyclical explicitly invoked human rights, criticising the ways in which, ‘in practice, human rights are not equal for all’. As nations and societies succumb to ‘disenchantment and disappointment’, ‘the temptation to build a culture of walls’ to keep out the ‘other’ grows ever greater. The antidote, Francis insisted, is a ‘culture of encounter’ in which it is again possible to ‘rediscover the needs of the brothers and sisters who orbit around us’. Priority, too, must be given to ‘the dignity of the poor’ and ‘respect for the natural environment,’ rather than the privileges of the affluent to continue to amass wealth at all costs. Only then – by aligning human rights with the global common good – can rights become truly universal.
This article investigates how the concept of ‘conscience’ emerged as a battleground within the French Catholic Church and as a politicized concept with implications for ideas about human rights. State-sponsored torture during the Algerian War (1954–62) prompted dissident Christians to pioneer the use of ‘individual conscience’ as a tool of resistance. The Christians of the anti-torture movement embraced the theologically informed language of conscience alongside a French, secular tradition of rights drawn from the 1789 Declaration of the Rights of Man and of the Citizen. The way that Catholic dissidents thought about rights transcended the secular–religious divide; while recognizing a liberal concept of rights coming out of the French Revolution, these Catholics also insisted upon the spiritual function of individual conscience as a check upon the state. Intra-Catholic debates about conscience thus reveal the political and theological diversity within mid-twentieth-century Christianity, long assumed to have been dominated by actors on the political right, as well as the multiplicity of coexisting ways of speaking about and interpreting human rights.
