Zakat, infaq, shadaqah, dan wakaf adalah bentuk ajaran Islam yang mengajak umat manusia untuk peduli terhadap sesama. Keempat filantropi ini memiliki persamaan yaitu sama-sama bernilai ibadah dan meningkatkan solidaritas antar umat. Keempatnya memiliki peran penting dalam pemberdayaan umat yakni dengan pendayagunaan dana filantropi tersebut dapat meminimalisir ketimpangan perekonomian masyarakat, mengentaskan kemiskinan, dan meminimalisir pengangguran yang mungkin menimbulkan keresahan dalam masyarakat sehingga terwujudlah masyarakat yang tentram makmur dan sejahtera. Namun demikian terdapat problematika dalam pengimplementasiannya yakni kesadaran masyarakat yang minim. Untuk mengantisipasi dan mencegah masalah-masalah yang menjadi penghambat dalam implementasi filantropi maka dibutuhkan strategi tertentu salah satunya berupa sosialisasi atau penyuluhan tentang zakat, infaq, sadaqah, wakaf, dan pembentukan badan yang khusus bertugas mengurusnya.
This paper discusses the influence of scientific socialism ideology on Islamic inheritance law in Somalia which is regulated in The Family Code 1975. This paper begins with a discussion of scientific socialism as a state ideology, then its influence on Islamic family law in Somalia and the application of scientific socialism ideology in inheritance law. The method used is descriptive with a theoretical approach that is explored through information media. The results of this study indicate that the deviation of family law regulations in Somalia from what is described in the Qur'an begins based on the concept of a state of scientific socialism that they apply. The purpose of implementing the ideology of scientific socialism in Somalia was to shift rigid customary rules and as a form of political cooperation with the Soviet Union. As a result, the application of the rules of family law has changed, especially in terms of inheritance. For example, there is no difference in the share of inheritance between husband and wife, sons and daughters, grandfather and grandmother, father and mother, even siblings, and half-siblings.
The religion of Islam is a religion of mercy for the whole of nature. Islam is a religion that is godly Allah Almighty and has a messenger, or Prophet Muhammad SAW. Islam determines a law or fiqh in performing worship with 4 (four) foundations, namely: the Qur'an, Hadith, Ijma' and qiyas. Emotional readiness is a situation of a state to live well in a case that cannot be changed, but with the mental courage of oneself being able to change things that should be changed, and also the wisdom to appreciate a difference. According to the Islamic view, some of the causes of young marriage are to carry out the sunnah of the Prophet, to open the door of sustenance, to perfect religion, to gain peace, and to obtain offspring. The reasons for marrying young in Bathin III Ulu District are parental demands, challenging economic conditions, low education, association, environment, understanding of customs, youth regulations, number of siblings, guardian wishes, matchmaking, clerical directions, and educational authority.
This article discusses the implementation of marriage isbat due to polygamy after the enactment of the Supreme Court Circular (SEMA) Number 3 of 2018. In the SEMA, the Supreme Court did not permit to ratify polygamous marriage isbat, but the decision of the Mataram Religious Court Number 634/Pdt.G /2018/PA.Mtr granted the application for polygamous marriage isbat. This paper aims to determine the decidendi ratio in the acceptance of the isbat of polygamous marriages. This research applies a statutory approach in a case. This study concludes that the Panel of Judges granted the case in decision Number 634 by ignoring SEMA Number 3 of 2018. Realizing justice and benefit for Siri's wife as heirs so that she can disburse her husband's pension TASPEN fund is seen as more beneficial by the Panel of Judges. In this way, her husband's pension TASPEN funds can be used to meet the living needs of the Petitioner and his family. The implication is that the decision can be called a legal breakthrough from the point of view of progressive law because it is based on the benefit that is considered more significant than following the material law of polygamous marriage.
This paper examines efforts to maintain harmony for commuter marriage families. The basic thing to do to form a sakinah family for commuter marriage actors is to carry out the rights and obligations of each family member. Because the concept of a sakinah family will not be realized if it only relies on one person, it is required to create cooperation between family members with one. The research method uses a qualitative with an empirical approach. The results show that to maintain the harmony of the commuter marriage family, it is necessary to fulfil several aspects such as financial aspects, biological aspects, and psychological aspects, but to fulfil these aspects, additional steps are needed to create a harmonious family. These steps are needed to create a harmonious family. These steps are obtained using Bourdieu’s theory, namely social capital, charismatic, and habitus.
