Miejsce i rola prawa w myśleniu utopijnym -ideał czy społeczne wyobrażenie?Utopia i utopizm jako zjawiska intelektualne są wszechobecne na każdym etapie rozwoju myśli ludzkiej. Ich występowanie można zauważyć na wielu płaszczyznach refleksji nad rzeczywistością. Utopie mogą przybierać postać dzieła literackiego, teorii filozoficznej lub społecznej, a niekiedy pełnią rolę analogiczną do modeli naukowych 1 .Można je więc traktować jako istotne medium komunikacji kulturowej [Rüsen 2005, 280]. Występują w projektach zarówno prospektywnych, jak i retrospektywnych, stanowiąc próbę określenia alternatywnych sposobów funkcjonowania człowieka i społeczeństwa. Jak podkreśla S. Swieżawski, "we wszystkich epokach powraca odwieczne pytanie: co należy czynić, aby na świecie było lepiej -ulepszać przede wszystkim struktury życia społecznego, czy ulepszać ludzi?" [Swieżawski 1987, 219].Zdaniem Z. Baumana, utopie, jako wyobrażenia lepszego świata, charakteryzują się poczuciem niedopełnienia i pożądania, idącego w parze z krytyką zastanej rzeczywistości i dozą ryzyka co do możliwości jego urzeczywistnienia [Bauman 1976, 17]. Można je więc traktować jako wizje pewnej rzeczywistości, zawieszonej między przeszłością i przyszłością, co często naraża ich twórców na zarzut nieprzystosowania do teraźniejszości. J. Delumeau zauważa, że:1 Bliska myśleniu utopijnemu jest Weberowska koncepcja "typów idealnych", które, mimo że opierają się o wiedzę empiryczną, nie odwzorowują bezpośrednio rzeczywistości, ale mają charakter idealnego punktu odniesienia oraz miary, którą stosujemy podczas badania rzeczywistość. Jak zauważa J. Topolski, wśród typów idealnych Webera dotyczących działań ludzkich główną rolę odgrywa typ idealny działania racjonalnego, który może występować w najróżniejszych wersjach, najbardziej -ze względu na zmienne systemy wartości -adekwatnych do porównywania z konkretnymi działaniami. Porównanie to pozwala nam lepiej opisać sens działania (tzn. jego strukturę motywacyjną), a więc tym samym wyjaśnić (i zrozumieć) działanie, a także stanowi kryterium poprawności wyjaśniania [Topolski 1978, 20].
