The historical roots of the concept of original rights of the indigenous peoples of Brazil concerning the lands they traditionally occupy, enshrined in Article 231 of the Brazilian Federal Constitution of 1988, refer to the law of nations, taught by Iberian teachers of the 16th and 17th centuries, particularly with regard to the scholastic concept of domain. We also show how the concept of Indigenato, formulated in 1912 by João Mendes Junior, considered over the past decades as the one that best illuminates Article 231 of the Brazilian Constitution of 1988, is entirely founded on this Iberian school of natural law and law of nations, inviting us to a dialogue with the classics.
RESUMOAborda-se aqui a consciência crítica da conquista e colonização da América nas Universidades Ibéricas do Renascimento, com especial incidência nos mestres escolásticos de Coimbra e Évora. Mostra-se como esta Escola Ibérica sustentou que o papa não tinha poder temporal ou espiritual sobre os povos americanos, quedando-lhe apenas, em matéria temporal, poder indireto sobre os assuntos temporais entre os cristãos; que em consequência não lhe assiste o direito de castigar a idolatria ou a infidelidade entre esses povos; que o imperador não é senhor do mundo, porque tal poder não se sustenta nos direitos divino, natural ou humano; que o poder laico radica imediatamente na comunidade ou povo, a título de realização da natureza social do homem e que o poder dos príncipes pagãos, em si mesmo, não é de menor nem de distinta natureza do poder dos príncipes cristãos, embora este seja mais perfeito porque a graça não contraria a natureza mas aperfeiçoa-a; que o império é uma expectativa jurídica, dependente de um pacto livre; que o poder temporal não radica nem na fé nem na caridade e que a infidelidade não é título legítimo de guerra; mostrase também a génese do princípio de intervenção humanitária em defesa dos direitos naturais dos homens, à luz da autoridade universal do orbe, tornandose a pessoa humana em sujeito de direito das gentes, bem como o princípio * Este estudo foi elaborado no âmbito do projecto
Estudamos o modo como Suárez aprofundou uma tradição decisiva para fortalecer a ideia de comunidade universal de natureza supraestatal, assente em regras morais superiores à soberania dos estados, tendo como fundamento a dignidade da pessoa humana, a unidade do género humano, o bem comum universal e a igualdade natural das soberanias do orbe, tanto do ponto de vista do domínio de jurisdição como no de propriedade, suportada por conceções democráticas sobre a origem do poder civil. Visava-se, assim, um conceito de comunidade não meramente internacional, mas propriamente universal, ao mesmo tempo que se proclamava a legitimidade das soberanias indígenas no Novo Mundo, porque o poder civil não radicava na fé ou na caridade mas sim na razão natural e na sociabilidade dos homens.
We analyze the criticism of Vasco de Magalhães-Vilhena to the idealist conception of the history of philosophy, exercised from his own conception of philosophy as a form of social consciousness and ideology, submitted to the processual dynamics of time and history. In this sense, it is important to underline the way in which the conception of history is rejected as a discipline that deals with the contingent and the accidental, in opposition to which the ideal of a perennial philosophy would rise and the consequent valorization of immutability, removing what is historical of the essence of the philosophical.
We study the relation between the classical ideas of art and nature, in the plan of the idea of beauty, with special reference to the eigtheenth century Portuguese rhetoric. We show the primacy of nature over art, expressed by the privilege of the conceptual language, which requires the identification between nature and reason, considering rhetoric in the incidental plan.
