O debate acerca dos decisionismos/realismos presentes na forma de interpretarmos a linguagem do Estado social e democrático de Direito tem crescido exponencialmente nos últimos anos em virtude da relação entre o direito e a filosofia. A aproximação entre esses dois campos do conhecimento permite compreender a atuação ativista (protagonismo) do Judiciário e as compreensões inadequadas acerca das consequências jurídicas na aplicação de um princípio, bem como dos riscos que são impostos a Democracia, quando inexistem instrumentos e (pré-compreensões) necessários (filosófica e sociológica) para dar suporte à adequação da posição do juiz dentro da estrutural estatal. Para esse fim, amparamo-nos nesses dois viesses – a filosofia e a sociologia –, visando colocar em perspectiva os limites acerca dos critérios que serão utilizados pelos magistrados frente ao Estado Social e Democrático de Direito. Por esse motivo, ao defendermos esse modelo estatal (democrático), a decisão do juiz jamais poderá ser um instrumento de conformação das demandas sociais ou, ainda, da procura de uma verdade realista, mas somente a partir do controle racional e justificada (legal) da subjetividade do operador do Direito que conseguiremos preservar as conquistas civilizatórias, consagradas depois sangue e sacrifício humano, em nossa Constituição Federal.
