O intenso processo de ocupação territorial, uso desordenado dos recursos naturais e destruição de áreas verdes iniciadas no século XIX, são os principais motivos da intensa devastação das Florestas com Araucárias. Como meio de efetivação da proteção e desenvolvimento florestal, o Brasil adotou em sua política ambiental a criação do Sistema de Unidades de Conservação nas categorias, de proteção integral e uso sustentável. Uma alternativa viável é a regulação dos estoques de madeira no Estado por meio de Unidade de Conservação de Uso Sustentável. O que se pretende a partir deste ponto é analisar a possibilidade da criação de regulamentação do aproveitamento dos recursos naturais em espaços naturais protegidos. Para tanto, foram selecionadas e trabalhadas duas modalidades de Unidades de Conservação (UC), já existentes, e proposta a criação de uma nova modalidade, então denominada "Reservas Particulares de Desenvolvimento Sustentável (RPDS)". As Unidades de Proteção Integral têm desempenhado papel expressivo na preservação do Bioma Florestal com Araucária. Em contrapartida, as Unidades de Conservação de Uso Sustentável são inexpressivas no Bioma e necessitam de uma efetiva regulamentação para que desempenhem sua função ecológica e social. Medidas de incentivo à conservação das florestas particulares e ao uso sustentável dos recursos madeireiros e não madeireiros, somadas ao instrumental atualmente utilizado, podem contribuir com maior efetividade na conservação e recuperação do Bioma Florestal com Araucária. RESUMOEste é um estudo de caso que trata das influências do Imposto Territorial Rural (ITR) sobre a atividade florestal. As áreas estudadas estão distribuídas ao longo da bacia hidrográfica do rio Iguaçu, na região Oeste do estado do Paraná. Os dados foram adquiridos nas fichas cadastrais do Censo de Estabelecimentos Agropecuários (1993) e o valor do ITR foi calculado de acordo com a metodologia estabelecida na Instrução Normativa-SRF n 0 .43, de 07/05/97. Com os dados foram feitas análises de regressão e análise multivariada. As variáveis coletadas por propriedade foram a área total (Atha), áreas com produtos vegetais (AGha), pastagens (Pha), benfeitorias (Bha), floresta nativa (Fha). Uma das principais conclusões do trabalho é que a variável Fha/Atha, que representa a área florestal da propriedade, tem um peso significativo para o decréscimo no valor do Imposto Territorial Rural. The area studied is located along the Iguassu river, at the west region of the Paraná State. The data were collected from registers of "Censo de Estabelecimentos Agropecuários, 1993" (Agricultural properties census). The ITR was calculated according to the Instrução Normativa -SRF nº.43, 07.05.97. Multivariate methods and regression analysis were applied for data analysis. The variables used were the total area (Atha), areas with agriculture and reforestation (Agha), pasture (Pha), constructions (Bha), native forests (Fha). One of the main conclusions is that the Fha/Atha variable, the forest area on the properties, have a significant weight for the reduction of the ITR values.
ResumoCom a descoberta de novas tecnologias a partir dos séculos XIX e XX, um intenso processo de ocupação territorial se desencadeou, ocasionando uso desordenado dos recursos naturais e destruição de áreas verdes. O estado do Paraná possui atualmente menos de 10% de área florestal original, evidenciando a necessidade de se definirem novas políticas de desenvolvimento e conservação para as Florestas com Araucária. Dessa maneira, propõe-se a criação de instrumentos legais para incentivar o uso racional e o aumento da cobertura florestal com araucária no Paraná, mediante a adoção de novos critérios para a arrecadação de duas espécies tributárias: Imposto sobre Transmissão de Bens Imóveis (ITBI) e Imposto sobre Produtos Industrializados (IPI). Uma alternativa promissora está na adoção de novos programas de incentivo fiscal, destinados ao desenvolvimento do setor florestal e à proteção do meio ambiente. Adicionalmente, sugere-se a aplicação de uma alíquota progressiva para o ITBI, em função da qualidade e tamanho do remanescente que podem contribuir com maior efetividade na conservação e recuperação do bioma. Concomitantemente, a adoção de uma nova metodologia para o cálculo do valor do IPI exclusiva para artefatos de madeira forneceria subsídios para o desenvolvimento sustentável das florestas com araucária no Estado. Throughout the discovery of new technologies during the 19th and 20th centuries, territorial occupation was triggered, causing the unsustainable use of natural resources and the destruction of green areas. The state of Parana, currently holds approximately 5% of its original forest area, which highlights the necessity of developing new policies for development and conservation for the Araucaria Forest. Therefore, it is proposed to use legal economic instruments to encourage sustainable use and also aim towards increasing the Araucaria Forest cover in Parana. The economic instruments considered for use include: A tax on Transfer of Real Estate (ITBI) and a tax on Industrialized Products (IPI). The adoption of the new tax incentive programs in order to develop the forestry sector and protect the environment is a promising alternative to the more common forms of environmental regulation. Furthermore, it is suggested to apply a progressive rate for the ITBI, depending on the quality and size of the remaining forest which may contribute being greatly effective in the conservation and recovery of the biome. As result, the adoption of a new method for the calculation of the designated IPI level, exclusively for wood artifacts, should provide subsides for sustainable development of Araucaria forests in Parana. O objetivo central do presente estudo foi analisar a constitucionalidade, assim como os prós e contras de uma possível recategorização da Reserva Biológica Nascentes da Serra do Cachimbo, no Estado do Pará, para atender os critérios de desenvolvimento sustentável: economicamente viável, socialmente justo, e ambientalmente adequado. Verificou-se que é possível a alteração de categoria de uma UC de Proteção Integral, desde que por meio de Lei e compatível aos fins propostos pelo artigo 225 da Constituição Federal. As categorias que se pretende criar pelo PL no Senado 258/2009 e PL de Conversão 4/2017 são compatíveis com o uso e ocupação do solo, em vista disso, os prejuízos trazidos com a consolidação das novas Unidades de Conservação seriam mínimos quando comparados com o desenvolvimento sustentável que seria viabilizado na região. No entanto, somente estudos técnicos são capazes de confirmar se a área realmente enquadra-se nas novas categorias, o que garantiria adequação na forma de preservação da natureza.
