O artigo tem por objetivo investigar as principais causas que levam as crianças à situação de rua, bem como os motivos mais relevantes que dificultam a reversão dessa realidade, cada vez mais crescente. De igual modo, será objeto de estudo o cotidiano da vida das crianças na rua, incluindo as barreiras institucionais, a dificuldade de acesso aos serviços públicos, os relatos de violência e discriminação e a formação de identidade social. A pesquisa, de natureza qualitativa, segue o método descritivo, e é pautada em revisão bibliográfica, em artigos científicos e obras literárias sobre o tema, com enfoque histórico, visando a compreensão do processo de marginalização dos “meninos de rua”, rotulados como “menores” e/ou “pivetes”, ao tempo da doutrina da situação irregular, bem como as reminiscências desse processo na atualidade, mesmo quando, à luz da Constituição Federal e do Estatuto da Criança e do Adolescente, vigente a doutrina da proteção integral, as crianças em situação de rua são sujeitos de direitos fundamentais, em condição de extrema vulnerabilidade, o que demanda atenção cautelosa das políticas públicas. O artigo também se servirá de subsídios normativos, notadamente o Decreto 7.053/2009, a Resolução CNDH nº 40/2020, a Resolução CNJ nº 425/2021, e a observação geral nº 21 do Comitê das Nações Unidas sobre os direitos da criança. Ao final, conclui-se que, nada obstante o reconhecimento da subjetividade jurídica das crianças após a vigência da Constituição Federal, ainda se fazem necessários avanços no tratamento jurídico das crianças em situação de rua.
