Works in the natural sciences are provided with comparatively less copyright protection than literary works. Nevertheless, this protection is important for scientists. However, more recently, modern methods and techniques of information and documentation, such as reprography, microfilm archives, electronic data storage and retrieval, and data transmission have questioned the justification and effectiveness, even in principle, of this protection. A more detailed analysis demonstrates that this involves not so much a crisis of copyright law as a crisis of the entire field of scientific information.
Mehr und mehr werden in den Universitätsbibliotheken Videoreferate eingerichtet, die nicht nur käuflich erworbene Videoproduktionen an ihre Benutzer ausleihen, sondern zum Zwecke der Ausleihe auch Fernsehsendungen aufzeichnen möchten. Für die Bibliotheken stellt sich dabei stets die Frage, ob und inwieweit sie zu solchen Aufzeichnungen urheberrechtlich befugt sind, ob sie Vergütungen an urheberrechtliche Verwertungsgesellschaften bezahlen und welche Vorkehrun gen sie treffen müssen, um eine Haftung der Universität und des Personals der Bibliothek für eventuelle Urheberrechtsverletzungen der Bibliotheksbenutzer auszuschließen.
*) Der Veröffentlichung liegt ein Rechtsgutachten zugrunde, das der Verfasser im Jahre 1982 für die Bibliothek der Ludwig-Maximilians-Universität in München erstattet hat. ZahlreicheAnfragen aus Bibliotheks-und Behördenkreisen haben den BIBLIOTHEKSDIENST bewogen, das Gutachten im Einverständnis mit dem Verfasser in etwas gekürzter Fassung abzudrucken. Eine ausführlichere Untersuchung des Verfassers zum Thema, die in der Zeitschrift "Gewerblicher Rechtsschutz und Urheberrecht" erscheinen soll, ist in Vorbereitung.
