Description: The purpose of the article is to study theoretical and practical aspects of local government organization and activities in Eastern Europe. The subject of the article is the issues of legislative support of the financial and economic bases of functioning of the municipal authorities of the Eastern Europe Statesю Methodology. In the course of study general scientific and special methods were used, which are the means of scientific research. In particular, comparative legal method was used for the analysis of the norms of substantive law of Eastern European countries, scientific categories, definitions and approaches. Historical and legal method gave an opportunity to reveal the meaning of the concepts of «local budget», «local self-government», to highlight the development of scientific views on specific issues. System analysis method was applied for an integrated generalization of the features of each country under consideration. The system-structural method made it possible to determine the state and government objective factors in the financial and economic spheres. The results of the study. It is recognized that due to the relatively low share of income, the entire financial system of municipalities is unstable, as well as the economic conditions in which local self-government operates. Although the analysis showed that the size of municipal budgets gradually increased, in the end they do not correspond to the level of inflation in these countries Practical implications. To ensure the autonomy of local government, it is especially important to manage the own revenue base of the territories and reduce their dependence on subsidies from higher-level budgets. In our opinion, subsidies should cover only certain types of expenditures of either national or regional importance and ensure equalization of the financial situation of the territories. Value / originality. The analysis of the relevant legislation and legal literature of the countries in question allows us to conclude that the expenditure part of the minimum budget determined by the legislator is calculated according to the norms and standards established by representative higher authorities on the basis of the law and the available funds, while the revenues of the minimum budget should cover the minimum necessary expenses guaranteed by higher authorities.
The article investigates the theoretical and practical aspects of the main parameters of state and self-government structures, its interaction in the process of formation and development of the state, its separation from society. The authors make a general description of the state, local government, social sphere. Attention is paid to the issues of relations between local self-government and institutions of the state, society, institutions of human and citizen’ rights and freedoms. The objective factors of the relationship between the state and self-government principles are considered, including the degree of socio-economic maturity of society, the ratio and arrangement of social groups. An attempt to determine the role of the individual in the implementation of the harmonization of human and citizen rights and freedoms with the interests of the state and society has been made there.
Current problems in the protection of economic rights in Eastern Europe (the impact of the oil industry on the environment and human health, discrimination in employment, including the abuse of the rights of migrant workers and women) determine the potential for economic development. This scientific article based on: qualitative and quantitative methodology; combination of comprehensive and systematic approaches; case method; analysis of statistical indicators. The aim of the research is to analyze the protection of economic rights in Eastern European countries and their negative impact on the lives of citizens. It has been found that in addition to unresolved issues of non-payment of salaries and discrimination against various social groups, these countries have new problems in the field of protection of intellectual property rights through the development of the digital economy. The legal system carefully and slowly integrates the practice of developed countries to provide guarantees for the most vulnerable (women, migrant workers). As a result, Eastern European countries are characterized by slow structural changes in the economy and an average level of GDP per capita. Discrimination, which is characterized by differences, is among the main problems. Discrimination does not ensure equal access for women to all spheres of public life. The revealed connection between gender equality and the economic well-being of the population proves the importance of protecting economic rights as a tool to ensure the formation of a socially oriented market economy. In Eastern European countries, there is no consistent concept of equality regardless of the social-economic characteristics of the citizen. Judicial practice remains quite cautious in sentencing and there are cases of return to formal equality.
The authors attempt to explore the nature of local public authority, its sources of legitimacy, its types and forms. An idea of the constitutional and legal bases of the organization and activity of local public authorities and its bodies is given there. The existing systems of local self-government in different states are analyzed; attention is focused on the difference between the concepts of “self-government” and “management”. The problems of administrative reform in Ukraine in the context of globalization are analyzed there.
