The aim of this article is the detailed consideration of the scientific opinion on the substantiation of health claims related to lutein and maintenance of vision, which was published by European Food Safety Authority (EFSA). The findings regarding the efficacy of lutein are important for the legal product classification. Thus, the second part of this paper will focus on products containing lutein regarding the demarcation between foodstuffs and drugs. These products are often used in ophthalmology and therefore the assessment of the legal product classification is also important to know for the attending ophthalmologists. Summing up, it is stated that the national and European law for placing products containing lutein on the market will be harmonised for reasons of clarity, transparency and legal certainty but also providing tighter admission requirements for these kinds of products.
Zusammenfassung Hintergrund: Gesundheitsbezogene Angaben ?ber Lebensmittel sollten gem?? der Health-Claims-Verordnung (HCVO) nur f?r die Bewerbung von Lebensmitteln verwendet werden. Die Europ?ische Beh?rde f?r Lebensmittelsicherheit (kurz EFSA) hatte jedoch im Rahmen der Erstellung des Unionsregisters mit funktionellen gesundheitsbezogenen Angaben ebenso Aussagen zu Stoffen zu pr?fen, die auch in Arzneimitteln oder Medizinprodukten eingesetzt werden. Juristisch betrachtet, ergibt sich daraus die Fragestellung, ob zugelassene Angaben f?r Lebensmittel, welche betreffende Stoffe enthalten, nach geltendem Recht verwendet werden d?rfen. Methodik: Zur Identifizierung dieser Stoffe wurde eine qualitative Inhaltsanalyse von 341 EFSA-Gutachten realisiert. Anschlie?end erfolgte f?r das Fallbeispiel Melatonin eine kompakte Betrachtung der Zulassung zugrunde liegenden wissenschaftlichen Evidenz und der m?glichen rechtlichen Konsequenzen f?r die Bewerbung melatoninhaltiger Produkte sowie eine Untersuchung zu den Abgrenzungsfragen bei der Bewertung des Produktstatus. Ergebnisse: Insgesamt wurden 9 Substanzen identifiziert, deren Verwendung sowohl als Lebensmittel, Arzneitmittel oder Medizinprodukt denkbar ist. Dazu z?hlen Melatonin, medizinische Kohle, Monacolin K, Chitosan, Lactulose, Laktase, Troxerutin, Diosmin und Hesperidin. Die Aufnahme der sechs Erstgenannten in das Unionsregister erlauben bestimmte gesundheitsbezogene Angaben. Die Freigabe ist jedoch nicht gleichbedeutend mit einer Zulassung f?r das Inverkehrbringen des Stoffes in Lebensmitteln bzw. einer Einstufung als Lebensmittel. Bei dem EFSA-Pr?fverfahren erfolgte keine juristische Bewertung ?ber das ?Ob? der Zulassung einer gesundheitsbezogenen Angabe f?r die genannten Stoffe. Trotz eines positiven EFSA-Gutachtens besteht das Risiko, dass gesundheitsbezogene Angaben aufgrund des Arzneimittelstatus in den einzelnen Mitgliedsstaaten als krankheitsbezogene Werbung klassifiziert werden. Schlussfolgerungen: Die Zulassung einer Lebensmittel vorbehaltenen Gesundheitsaussage f?r Arzneimittel schlie?t sich rechtssystematisch aus. Kasuistiken wie bei Melatonin sind als gesundheitsbezogene Aussage nach der HCVO zugelassen, obwohl Produkte mit diesem Wirkstoff vielfach als Arzneimittel im Sinne des Grundsatzes des Vorrangs des Arzneimittelrechts eingeordnet werden.
