На підставі аналізу чинних нормативно-правових актів, якими регламентується статус Вищої кваліфікаційної комісії суддів України, визначено роль і місце Комісії в системі органів суддівського врядування. Враховуючи проблеми з формуванням Вищої кваліфікаційної комісії суддів України, яка й дотепер не сформована, та неможливістю реалізації покладених на неї повноважень, встановлено, що сьогодні нагальною проблемою є пошук шляхів для забезпечення створення Вищої кваліфікаційної комісії суддів України для вирішення питань відбору суддів і формування незалежного та професійного суддівського корпусу. Вважаємо недоцільною пропозицію членів ВРП утворити Кваліфікаційну палату кадрового забезпечення судової системи з підпорядкуванням ВРП, замість цієї Комісії. Охарактеризовано співвідношення правового статусу Вищої кваліфікаційної комісії суддів України та Вищої ради правосуддя як органів суддівського врядування, перспективи їх подальшого функціонування для нагального вирішення проблем у сфері кадрової політики. Аналіз повноважень зазначених органів свідчить про їх взаємоузгодженість та взаємну доповнюваність. З’ясовано, що міжнародні стандарти у сфері правосуддя передбачають необхідність утворення органу, який здійснюватиме формування суддівського корпусу, роль якого з урахуванням цих стандартів і міжнародного досвіду функціонування аналогічних органів виконує Вища рада правосуддя, а також реалізацію положень Стратегії щодо забезпечення інституційної самостійності й транспарентності Вищої кваліфікаційної комісії суддів України та опрацювання питання щодо її підпорядкування Вищій раді правосуддя як органу з добору кадрів та кар’єри суддів. Вважаємо за доцільне існування Комісії як самостійного органу суддівського врядування.
