El control de constitucionalidad ha atravesado distintas fases. En un inicio, se trató de una institución desacreditada, particularmente en Europa. Esto se debía a que el “culto a la ley” se encontraba arraigado en esa parte del mundo. En ese contexto, una forma inicial se hacer compatible esta noción con la del control de constitucionalidad fue el “control previo de constitucionalidad”, el cual permitía fiscalizar el contenido de las leyes, pero antes que estas fueran publicadas. Con posterioridad, esta herramienta ha sido incorporada con el propósito de evitar el surgimiento de la responsabilidad internacional del Estado. Este artículo busca demostrar cómo el control preventivo es indispensable para garantizar el equilibrio entre la supremacía constitucional y el principio pacta sunt servanda.
El control de convencionalidad ha planteado importantes interrogantes en los ordenamientos jurídicos nacionales. En esta investigación, se examinan dos escenarios en los que pueden presentarse ciertas resistencias a su implementación. El primero se relaciona con los modelos que la doctrina ha denominado como weak form constitutionalism, que optan por no brindar la última palabra con respecto a la interpretación de los derechos a los tribunales de justicia. Por otro lado, también se cuestiona el hecho de que este control impide la articulación de un diálogo entre tribunales, ya que no permite que los jueces nacionales expongan su lectura de los derechos fundamentales.
El presente artículo se relaciona con la interpretación de la Constitución, particularmente de lo que algunos teóricos han denominado el “originalismo”. De esta forma, serán objeto de estudio tanto el contexto histórico en que este movimiento surgió, como los factores que lo propiciaron. En el desarrollo de esta labor, se advertirá que existen distintas formas de entender lo que el originalismo significa, y que no necesariamente todos los partidarios de esta corriente entienden la interpretación jurídica de la misma forma. Finalmente, se hará referencia a las principales críticas que ha recibido, sobre todo de aquellos que consideran que la Constitución debe ser entendida como un instrumento vivo, que debe adecuarse a las necesidades de cada sociedad.
El presente trabajo explora las bases, en el caso peruano, de lo que la doctrina ha denominado como “derecho constitucional internacional”. De esta forma, se analizará cómo es que en el siglo XIX se empezaron a establecer las bases de esta disciplina. Se demostrará que, pese al silencio de los constituyentes de esa época, existieron distintos pensadores peruanos que se preocuparon en analizar cuestiones como las relaciones entre el derecho local con el internacional y la posición de los tratados en el ordenamiento jurídico. Del mismo modo, también se examinará la visión que el Estado peruano tenía sobre los aspectos concernientes al derecho internacional.

El constitucionalismo peruano del siglo XIX tiene diversas fuentes inspiradoras. No existe duda que una de las principales fue la española, lo cual obedecía a los lazos históricos y culturales que nos unían a dicha nación. Sin embargo, eso desde ningún punto de vista debe suponer que se pierda de vista la importancia que otros movimientos tuvieron en la ulterior evolución de nuestras constituciones. En ese sentido, debe destarcarse el caso de la revolución francesa, movimiento con tendencias universales cuyos postulados dejaron una importante huella en los pensadores peruanos de aquella época. En esta investigación se destacan los principales ámbitos en los que se ha podido advertir la influencia francesa en el primer texto constitucional peruano. Para ello, se precisa qué es lo que significó la revolución francesa y cómo es que impacta en nuestro país. Con posterioridad, se destaca el importante rol que, en esta influencia, tuvo la Declaración de los Derechos del Hombre y del Ciudadano de 1789 en el primer constitucionalismo peruano del siglo XIX, y, especialmente, en el texto de 1823.
