Dünyayı etkisi altına alan Covid-19 salgını ülkemiz ekonomisini de olumsuz etkilemiştir. Bu olumsuz durumun ekonomik idare hukuku kapsamında iyileştirilmesi için pek çok düzenleme yapılmıştır. İlk olarak 7226 sayılı Torba Yasa’nın 49. Maddesi ile Çek Kanunu’na geçici 5. Madde eklenmiş ve bununla cezaların infazı öngörülen sürelerde çek bedelinin on da birinin ödenmesi şartıyla durdurulmuştur. Nihayet 7333 sayılı Torba Kanun, 28.07.2021 tarihinde kabul edilmiş ve 31551 sayılı Resmi Gazetede yayımlanarak yürürlüğe girmiştir. Bu Torba Yasanın 17. Maddesi ile çek bedelinin on da birinin ödenmesi için öngörülen süre 30.06.2022 tarihine kadar uzatılmıştır. Torba Kanunun 17. Maddesine göre infaz ertelemesi, 30.04.2021 tarihine kadar işlenen suçları kapsamaktadır ki bu infaz etelemesinden yararlanacakların kapsamını önceki düzenlemeye göre genişletmiş durumdadır. Ark arkaya yapılan bu infaz ertelemeleri ve bunların kapsamının genişletilmesi, soruna kısa vadede ve salt borçlu tarafın mağduriyetini giderir nitelikte geçici bir çözüm getirmektedir. Tüm tarafların mağduriyetlerini gideren uzun vadede kalıcı bir çözüm halihazırda sunulabilmiş değildir. Çalışmanın konusu alternatif bir çözüm yolu olarak Sigorta Hukuku’nun özellikle de karşılıklı sigorta türünün nasıl bir çözüm sunabileceği ve mevcut sigorta sistemi içerisinde nasıl bir yöntem izlenebileceği olacaktır. Ayrıca elektronik çek sisteminin sorunun çözümünde etkili olup olmayacağı üzerinde de kısaca durulacaktır. Çalışmada ilk olarak karşılıksız çek keşidesinin altında yatan temel etkenler araştırılmış ve güncel veriler ışığında bir değerlendirme yapılmıştır. Ardından karşılıklı sigorta kavramı ve Türkiye’deki örnekleri Katılım Sigortacılığı incelenmiş, çek bedelinin sigortalanmasının piyasaya olası etkileri tartışılmıştır.
