Considering research on juvenile delinquency more broadly, few studies have examined the legal socialization process whereby adolescents come to accept legal authority and comply with the law as a result of the interaction with informal and formal socializing agents. Police legitimacy is an important dimension of legal socialization, because the police are the visible face of the legal system and contribute to the internalization of norms and values in society. Therefore, this article aims to analyse police legitimacy perceptions as an element of the legal socialization process in Spain among a subsample of 2041 youths aged from 13 to 18 from the Third International Self-Report Delinquency Study (ISRD-3). The results using structural equation modelling reveal that adolescents who perceive the police as a legitimate institution commit fewer criminal offences. Additionally, police legitimacy perceptions mediate the association of parental monitoring, school attachment and procedural justice of the police with juvenile delinquency. Other explanations for juvenile delinquency are discussed from a legal socialization perspective.
ResumenEl rol desempeñado por la opinión pública en el desarrollo de la política criminal actual justifica el incremento de investigaciones destinadas a evaluar las actitudes de los ciudadanos hacia el castigo. No obstante, los avances en este ámbito han sido limitados debido a la utilización de rudimentarios instrumentos de medida. Por ello, el presente trabajo tiene como propósito explorar la influencia que tienen ciertas variables referidas al hecho delictivo y al infractor sobre la elección de las penas. Para satisfacer este objetivo se recurrió a un diseño factorial de la encuesta, creando una población de 256 casos-escenario fruto de la combinación de cuatro variables: la edad del joven, su historial delictivo, el grado de implicación en el hecho y el tipo de delito cometido. Los mismos fueron distribuidos en grupos de ocho casos ordenados aleatoriamente y fueron suministrados a 32 sujetos. Posteriormente se aplicaron análisis de regresión logística binaria. Los resultados obtenidos revelan que la naturaleza violenta de los hechos, la implicación activa de los jóvenes y el historial delictivo son predictores importantes de las condenas punitivas. Sin embargo la edad, una variable fundamental en la configuración de la justicia juvenil, no resulta significativa. De este modo, el trabajo muestra el potencial explicativo de este conjunto de factores y debate sus implicaciones teóricas y metodológicas para la investigación futura en este terreno.Palabras clave: actitudes punitivas; delincuencia juvenil; política criminal; diseño factorial de la encuesta; caso-escenario.
En este trabajo se presentan los resultados de una investigación que ha evaluado las percepciones de 131 jóvenes infractores sobre su experiencia judicial. En concreto se han analizado sus percepciones de justicia procedimental y de competencia legal. Al mismo tiempo, se han analizado también sus opiniones en relación con la interacción con su letrado, que es uno de los agentes con los que más debe tratar el joven infractor y el principal responsable de incrementar su competencia legal. Los resultados han puesto de manifiesto que los jóvenes no están plenamente satisfechos con la experiencia. Además, se ha comprobado que la satisfacción depende en gran medida de sus percepciones de justicia procedimental y de competencia legal. Por otra parte, se ha comprobado la importancia del contacto previo con el abogado para que la interacción sea de más calidad y mejoren las percepciones de los chicos. Aun así, estas percepciones concretas sobre este profesional no condicionan la valoración global de la experiencia judicial.
