Instruments in terms of the provisions of the mining law has been regulated by law No. 11 of 1967, in AbstrakInstrumen hukum dalam hal ketentuan pertambangan telah diatur dalam undang-undang Nomor 11 Tahun 1967, dimana kedudukan hukum pemerintah belum sebanding dengan para investor. pemberian izin itu adalah kewenangan pemerintah atau penguasa dalam rangka melindungi kepentingan warga negara dalam rangka menuju tindakan konkrit walapun menyimpang dari ketentuan-ketentuan yang dilarang. Tata kepemerintahan yang baik atau good governance berhubungan sangat erat dengan hakhak asasi. Dengan demikian bahwa salah satu yang melandaskan adanya suatu penopang atau pondasi suatu hakikat diskresi dalam hal ini yakni izin oleh pemerintah khusunya dibidang pertambangan adalah adanya tata kelola pemeritahan yang baik atau good governance sehingga tercipta suatu harmonisasi sebagai penyelenggara negara. dalam membuat beschikking (suatu keputusan), pemerintah harus memperhatikan ketentuan-ketentuan atau syarat-syarat tertentu. Apabila syaratsyarat tertentu dimaksud tidak dipenuhi berakibat keputusan yang dibuat tidak sah. Secara umum beschikking (keputusan) dapat dibagi dalam dua macam keputusan, yakni rechtsgeldige beschikking (keputusan yang sah) dan niet-rechtsgeldinge beschikking (keputusan yang tidak sah). The purpose of this research is to determine whether the rehabilitation of the victims of narcotics abuse in the decree of the District Court of Kendari No. 236/Pid. Sus/2019/PN K has fulfilled the element of Article 54 Act number 35 year 2009. The type of research used in this study is normative research, using the Statute Approach, Case Approach, Conceptual Approach.Based on the results the authors conclude that narcotic addicts and narcotics abuse victims are obliged to undergo medical rehabilitation and social rehabilitation. The judge in the its verdict prosecute convicted because it has been proven legally and committed guilty of committing a criminal offence "narcotic abuse for himself", dropping a criminal against the defendant with imprisonment for 1 (one) year and 2 (two) months have in accordance with article 127 paragraph (1) of Law No. 35 Year 2009. However, in the ruling judge ignores article 127 paragraph (2) and paragraph (3) of Law No. 35 Year 2009 that the obligation of the judge in providing rehabilitation efforts against the defendant cases of drug abuse in line with the issuance of Circular Letter of Supreme Court No. 4 Year 2010.
This research aims to theoretically analyze the description of criminal provisions of Law 32/2009 concerning Protection and Management of the Environment. It also discusses criminal sanctions for unlawful environments in Indonesia, comprising of irregularities. Practically, it has awkward or inappropriate dealt with its application. Since the types of environmental crime were not directly related to environmental conservation. This study makes use of a conceptual, law, and case approach. The results of the study stated that environmental protection and management are laws below the specialist. However, in the criminal provisions section, there is no conformity and alignment, as its principle prohibited criminal acts, and upheld the spirit of environmental protection and management. Also, criminal provisions do not consider the environment as their actual victim. Comprehension in the Law on Protection and Management of the Environment is a criminal provision which has not led to environmental protection. The first problem which is imprisonment is substantially clear as there is no influence on the victim (environment). Secondly, following criminal penalties, it is still unclear whether the government uses the cost of fines from defendants for the restoration of damaged environments. The application of these methods tends to create a holistic and integrated policy in managing and optimizing the environment as a source of collective strategy for the benefit of human life.
The reform of the Indonesian Penal Code (KUHP) is necessary to accommodate the noble values of Indonesian society. Therefore, Indonesian criminal law should reflect the basic principles, cultural values that live within the inner niches of Indonesian society as a living law. The inclusion of several forms of obscene acts that exist within the extended Draft Penal Code is a manifestation of the philosophical, sociological and juridical framework of the Indonesian society. The extension of the concept of obscenity in the Draft of Indonesian Penal Code is in accordance with the philosophy of the Indonesian nation that gives religious values a fundamental place Consequently, the expansion of the concept of obscenity in the Draft of Indonesia Penal Code can answer some of the problems faced by Indonesian citizens.
AbstrakRumusan maladministrasi masih mencampuradukan antara kesalahan dan atau tanggung jawab jabatan dengan kesalahan dan atau tanggung jawa pribadi. definisi maladministrasi. Terkait dengan ketentuan pidana UU No.4 Tahun 2009, formulasi pasal 165 tidak menentukan unsur kesalahan serta kesengajaan dan kelapaan dolus dan culpa berkaitan dengan pertanggungjawaban pidana. Di samping itu, ketentuan pidana dalam UU No. 4 Tahun 2009 belum memprekripsikan tentang kejahatan jabatan secara utuh, hanya memuat satu pasal yakni pasal 165. Padahal dalam berbagai kasus kepala daerah terkait dengan izin pertambangan di beberapa daerah, begitu banyaknya tumpang tindih izin yang disebabkan oleh maladministrasi pejabat berwenang.Kata Kunci : maladministrasi, tanggung jawab, izin.
