ZusammenfassungWie wird Einwilligung, ein von feministischen Anti-Vergewaltigungsaktivistinnen politisiertes Konzept, von AkteurInnen a priori fernab der Frauenbewegung verstanden und adaptiert? Ist es im Kampf gegen sexuelle Gewalt relevant, dem polizeilichen ein feministisches Verständnis entgegenzusetzen? Auf diese Fragen schlägt dieser Artikel eine Antwort vor, indem er die feministische Rechtstheorie, die Soziologie der sozialen Bewegungen und die Soziologie der Polizei zusammenliest. Er basiert auf einer zehnmonatigen empirischen Untersuchung in einer Polizeidienststelle in einem großen französischen Ballungsraum. Der erste Teil des Artikels befasst sich mit den feministischen Mobilisierungen gegen Vergewaltigungen seit den 1970er Jahren und mit deren partiellem Transfer in die Strafverfolgung. Dieser Teil zeigt, dass die Kriminalisierung von Vergewaltigungen in feministischen Verbänden kaum in Frage gestellt wird. Cet article interroge le rôle policier dans le traitement pénal des viols, négligé par la sociologie et la critique féministe du droit des violences sexuelles. À partir de l’étude des mains courantes enregistrées par un service de police judiciaire, il revient sur une des conclusions de la théorie féministe du droit, à savoir que le traitement pénal des viols est principalement déterminé par la formulation de la règle de droit. Les données mobilisées sont issues d’une ethnographie de dix mois dans un service de police judiciaire et de l’exploitation des archives de ce service. L’enquête met en évidence la faible autonomie de la police judiciaire en matière de traitement des viols du fait de contraintes structurelles et politiques. Elle montre ensuite que la déqualification des plaintes varie suivant la proximité relationnelle entre la victime et le suspect, et dépend de l’interprétation policière de la passivité des victimes.
