This paper aims to apply the principle of maalat af’al (consequences of an action) in analysing the issue of women converting to Islam without their husbands from the perspective of maslahah (public interest). Despite the fact that the majority of classical scholars maintain the view that this marriage must be dissolved, dealing with this case in Muslim minority circumstances needs more consideration, particularly in terms of maslahah (securing benefit and removing harm) and mafsadah (harm). Dissolving this marriage immediately could portray a negative image of Islam as a religion that divides families with psychological and emotional impacts on women and their families. This is a qualitative study that obtained data from interviews with several imams and scholars in the UK. The findings indicate that this is a contemporary ijtihadi issue, with some aspects tolerated. Also, the status of maslahah in this issue is in line with the Shari’ah, particularly in facilitating a new Muslim life. While this study is merely exploratory with a limited number of participants, linking theory and reality makes the discussion on the issue and applying the principle of maalat practical.
Ethical culture and integrity values are the bases that a nation needs to establish in order to achieve optimum development. A nation’s identity and reputation will become tarnished if the two elements are not presented in at least, adequate scale. Ethics that are meant to bring eminence in an organization have to be expanded to form a high-minded society, in accordance with the concept of Islam which is progressively being put into practice today. This paperwork is going to deepen and analyse Islamic sources which are al-Quran, al Hadith and Seerah Nabawiyyah (Biography of Muhammad PUBH) with specificity in the particular topic discussed here, which is organizational ethics. Related verses from al-Quran and hadiths will be scrutinized. This will include the bases, purposes and demands of ethical forming. Concepts and principles of organizational ethics will be explained in details by which verdicts from former and current scholars are made reference to. It is hoped that through the ethical approaches suggested in this paperwork, outstanding and productive organizations can be deftly produced in the future.
This paper aims to explore the potential of cash waqf-based crowdfunding as a source to obtain funds for single mother entrepreneurs. It has been discovered that single mothers are physically, emotionally, and financially struggling to support their lives and perhaps their families. Based on the library research, this study applies the inductive approach and descriptive method in analysing with related works of literature. The finding acknowledges that crowdfunding is frequently argued as a viable alternative to traditional financial institutions. Nevertheless, this approach appears to be different for single mother entrepreneurs, also known as micro-enterprises, because the majority of them lack training, skills and management for attracting investors to support their business. As a result, the findings proposed a unique model of cash waqf-based crowdfunding fund for single mother entrepreneurs. Although this study is based on library research, its findings may not be applicable in terms of the theoretical aspects. Meanwhile, it still creates valuable contributions in accordance of developing a practical model of Islamic crowdfunding particularly cash waqf-based for single mother entrepreneurs in Malaysia. The special model of Islamic crowdfunding that is proposed by this study can potentially support single mother entrepreneurs, if it is applied to a real platform that may reduce the burden of the government bureaucracy because most of them lack financial constraints. Furthermore, this study expands the potential for the application of cash waqf-based crowdfunding as a practical solution for single mother entrepreneurs in Malaysia. Although Islamic crowdfunding is not a new research topic and applications of Islamic crowdfunding as a tool, empirical studies in this area are still limited, specifically investigating the use of Islamic crowdfunding. Despite the fact that this study is conceptual, it provides a practical model which can be utilised as a crowdfunding tool to empower entrepreneurs, especially single mothers.
This paper aims to clarify how maqaṣid al-Shari’ah (objective of Shariah law) plays its role in Islamic finance, particularly in creating a harmony between Shariah rulings in theory and their application in current circumstances. Based on library research, this study applies inductive approach and descriptive method in analysing various literatures. The finding reveals that the roles of maqasid al-Shari’ah are identified as the following: harmonizing between the text of revelation and the actual situation; considering unusual circumstances and overcoming current issues. All of them reflect how maqasid al-Shariah could pragmatically adapt Shariah rulings into the real operation of Islamic finance. Since this paper comes up with two cases: replicating conventional products to be Islamic ones and implementing floating rate in Islamic prices, it provides a practical discussion on this topic.
يهدف هذا البحث لبيان دور اعتبار المآلات في إصدار الفتاوى للأقليات الإسلامية المقيمة في البلاد التي لا تدين بالإسلام؛ من خلال الإجابة على سؤلين رئيسين؛ هما: ما الفتاوى التي يحتاج إليها المسلمون في واقع الأقليات المسلمة؟ وكيف يؤدي اعتبار المآلات دوراً في إصدار الفتاوى للأقليات الإسلامية المقيمة في البلاد غير المسلمين؟ اتبع البحث المنهج الاستقرائي والوصفي التحليلي، وليكون هذا البحث واقعياً، قامت الباحثة بدراسة الخاصة في القضايا المتعلقة بالأقليات المسلمة، وهي: إسلام المرأة المتزوجة دون زوجها، والزواج بين المسلم والكتابية، وقد توصل البحث إلى نتيجتين، أولهما؛ حاجة الأقلية المسلمة المقيمة في البلاد التي لا تدين بالإسلام إلى فتاوى تتمكن، من خلالها، من معالجة مشاكلها وفقاً لأحكام الشريعة الإسلامية، حيث يراعي فيها مصلحة الدين ومصلحتها معاً. وثانيهما؛ عدم قدرة المفتي على تعميم أحكامه في قضايا مثل هذا الزواج؛ لأن الأحكام متفاوتة بين قضية وأخرى، لذلك، يحتاج إلى النظر في كل حالة على حدة؛ فاعتبار المآلات يرشد المفتى من خلال نتائج فتواه في علاج هذه المشكلات حتى لا يؤدي إلى حصول مفسدة.
