Iako je pristanak oštećenika pojam koji je materijalno identičan u građanskom i kaznenom pravu, njegov je učinak različit. Dok u hrvatskom odštetnom pravu pravno valjan pristanak pacijenta kao oštećenika isključuje protupravnost medicinske intervencije, to nije slučaj u kaznenom pravu. Zbog složenosti ove problematike autorica obrađuju pojmove različitih vrsta pristanka pacijenta, od pretpostavljenog pristanka, zamjenskog ili surogat-pristanka do anticipirane naredbe/punomoći za slučaj nesposobnosti te posebno analizira sve uvjete potrebne za njegovu valjanost. Budući da u kaznenom pravu postoje različita stajališta o učinku pristanka oštećenika uopće, u radu su posebno prikazana dva suprotna stajališta zastupljena u komparativnom pravu u pogledu učinka pristanka pacijenta na medicinski zahvat. Autorica prikazuje normativni model ekskulpacijskog učinka pristanka prema kojemu nanošenje teške ili osobito teške tjelesne ozljede u liječenju ili djelatnosti u svrhu liječenja nije protupravno ako je pacijent dao pristanak u obliku i pod uvjetima predviđenima zakonom, te model prema kojemu je pristanak oštećenika bitan samo za biće djela.
Današnje uređenje pravne odgovornosti liječnika, ali i drugih medicinskih djelatnika ne može se razumijeti bez uvida u povijest razvitka te vrste profesionalne odgovornosti. Autorica prikazuje uređenje odgovornosti liječnika u pravnim dokumentima starog vijeka, uključujući mezopotamijske i egipatske izvore te dokumente iz antičke Grčke i rimskog prava. Također, rad analizira pravno uređenje liječničke odgovornosti u srednjovjekovnom pravu kao i razvitak te odgovornosti nakon Francuske revolucije. Autorica posebno prikazuje užasnu zlouporabu liječnika i njihovu odgovornost za nacističke zločine. Zaključno, ukazuje da u suvremenim društvima sustav profesionalne pravne odgovornosti liječnika predstavlja srednji put između dviju krajnosti.
The battle against the COVID-19 pandemic is still the most important problem and a great challenge for the overburdened health system in the Republic of Croatia. This paper examines the research into how violations of humans’ right to health occurred due to the inaccessibility to health protection for uninfected persons during the COVID-19 pandemic. The research implemented showed that a system of anti-epidemic measures which completely suspended or significantly reduced the possibility to access primary and hospital health care, stopped preventive programs of cancer detection. Much medical research has already revealed the possible harmful effects to people's health in the increase in cases of the contraction of and death from cancer and other serious illnesses, particularly in relation to certain vulnerable groups for example, women and oncology patients. The author concludes that the right to access protection of health during the COVID-19 pandemic in the Republic of Croatia was significantly limited and analyzes possible legal consequences which could occur due to the suspension or limitation to the right to access health care as a violation of the right to health.
Court proceedings in the field of medical law are currently a growing issue given the increasing migration of doctors and medical staff. Because of that fact, it is crucial to establish the standard of quality of health protection in the European Union (EU). Following the presentation of the existing levels of protection connected with the prevention of malpractice, the paper distinguishes between the legal documents of the EU and the Council of Europe because many documents related to health care and quality are adopted in the EU and in the Council of Europe. The general conclusion is that there is no uniform or cross-sectoral definition of quality in health care, however it has been found that important elements of health care quality include effectiveness, efficiency, access, safety, equity, appropriateness, timeliness, acceptability, satisfaction, patient responsiveness or patient-centeredness, and continuity of care. The health care aspect is analysed in the continental legal system and the common law legal system. The issue of causation is observed through different theories in the continental legal system and various case law examples in the common law legal system. The authors concluded that it would be preferable to adopt a theory of objective imputation as a legal standard for causation in criminal liability in medicine, because it analyses several possible causes in close or remote connection with the resulting consequence, i.e. said theory considers as relevant only the legal causes that result in a harmful event through the violation of due diligence. The paper primarily deals with criminal liability for malpractice, but it also presents the civil aspects in the states (for example the USA) which recognise only civil liability for malpractice.
Općeprihvaćen stav da sloboda pacijentove volje ima prevlast nad medicinskim razlozima, ipak, nije apsolutan jer se u novije vrijeme smatra da je načelo apsolutne prednosti prava na samoodređenje što se tiče života, tijela i zdravlja potrebno ograničiti. U radu se prikazuju međunarodni i domaći pravni okviri za pravo na odbijanje dijagnostičkog/terapijskog postupka te u kojim je slučajevima i pod kojim uvjetima to pravo ograničeno. Posebno se analizira postupanje liječnika i drugih zdravstvenih radnika te rješenje pitanja krše li oni prihvaćanjem odbijanja pravnu normu i pravila svoje struke ili postoji njihova obveza na neodgodivu intervenciju čije bi nepoduzimanje ugrozilo život i zdravlje ili izazvalo trajna oštećenja pacijentova zdravlja. Autorica obrađuje i pravne aspekte složene problematike odbijanja liječenja kod određenih kategorija vulnerabilnih osoba, djece, osoba s duševnim smetnjama, u odlukama o okončanju života umirućih bolesnika te štrajka glađu zatvorenika. U radu se naglašava da konflikt između prava na odbijanje medicinskog tretmana i interesa države za očuvanje života i zdravlja može otvoriti pitanja različitih vrsta odgovornosti zdravstvenih radnika, od nesavjesnog liječenja ili nepružanja hitne medicinske pomoći do odštetne i/ili disciplinske odgovornosti. Autorica posebno ističe neusklađenu i nejasnu pravnu regulativu koja dovodi zdravstvene radnike do njihove pravne nesigurnosti zbog dileme kojem propisu u praksi dati prednost.
