O sistema prisional brasileiro é caracterizado por múltiplas violências, sendo nacional e internacionalmente conhecido pelas recorrentes violações aos direitos humanos. Em meio às engrenagens punitivas da prisão, as famílias dos apenados, notadamente as mulheres, exercem destacado papel no tocante ao suporte afetivo e material dedicado aos presos. Apesar disso, observa-se que os familiares são frequentemente tratados de forma tirânica pelo Estado, sendo submetidos a humilhações e embaraços incompatíveis com a dignidade humana. O objetivo deste artigo é problematizar as principais violações aos direitos humanos impostas às famílias do cárcere, bem como possíveis impactos à sua subjetividade. Para tanto, a metodologia utilizada foi a da pesquisa bibliográfica, realizada a partir de revisão da literatura científica sobre o tema. Os principais resultados apontam para a corriqueira e banalizada violência institucional perpetrada pelo Estado contra familiares de presos. Dentre as violações que se destacaram no estudo realizado, destacam-se as dificuldades impostas ao acesso à justiça e as humilhações vivenciadas nos processos de revista e visita íntima. Conclui-se reconhecendo a importância da presença familiar como componente inequívoco dos processos de ressocialização. Ao mesmo tempo, demonstra-se que tais famílias são frequentemente abandonadas pelo Poder Público ou, ainda, punidas sem terem cometido crime algum, reforçando o entendimento de que tal fenômeno se trata de uma “pena compartilhada” entre apenados e seus familiares.
