Après une compréhension historicisée de la notion d’« asile », de ses conditions en Afrique, et de ses transformations internationales depuis la Seconde Guerre Mondiale et les Indépendances africaines, cet article offre dans un second temps une analyse de la protection des réfugiés et des demandeurs d'asile et de ses limites au Sénégal. L’analyse explore les différentes mesures prises par les autorités sénégalaises au fil des décennies, au regard du système de protection africain des réfugiés et du droit international en la matière. Cet article souhaite ainsi contribuer à orienter vers une réforme du droit d’asile à l'échelle locale.
Cet article porte sur l’expansion du mandat de l’Agence européenne de garde-frontières et de garde-côtes (Frontex) depuis sa création en 2005. Il analyse l’impact des pouvoirs grandissants de l’Agence sur les droits humains des migrants. Comme le montre le Nouveau Pacte sur la Migration et l’Asile de 2020, l’Agence bénéficie d’un soutien politique sans faille dans la gestion intégrée des frontières extérieures des États membres de l’Union européenne. Elle peut notamment procéder à des opérations conjointes maritimes, terrestres et aériennes de contrôle des mouvements migratoires et de renvois forcés, en plus de pouvoir déployer des agents dans les pays tiers. En 2021, un contingent permanent du corps européen de garde-frontières et de garde-côtes doté de pouvoirs d’exécution verra le jour. Nous soutenons que cette expansion considérable reflète la préférence de l’UE et de ses États membres de répondre à la pression migratoire essentiellement par des mesures de sécurisation de leurs frontières afin de dissuader et réprimer des migrants indésirés. Cette approche est non seulement contre-productive mais aussi elle engendre de graves atteintes aux droits des migrants visés, y compris des demandeurs d’asile. Malgré certaines améliorations apportées au mandat de l’Agence pour un meilleur respect des droits humains, ce but est loin d’être atteint. L’absence de règles claires d’imputation de responsabilité et d’un recours effectif en cas d’atteintes aux droits est particulièrement problématique.
Résumé Le but de cet article, qui porte sur la contribution des pays d’origine et de transit des migrants dans la lutte contre l’immigration irrégulière en Europe, est d’analyser l’intervention de ces acteurs dans la gestion des flux migratoires et le contrôle des frontières, ainsi que des incidences de celle-ci sur les droits des migrants économiques et des demandeurs d’asile malgré leur nette différence de statut. Nous démontrons que les moyens et mesures pris par les pays tiers dans la mise en oeuvre de la lutte de l’Union européenne contre l’immigration irrégulière participent non seulement à cette distinction entre les migrants économiques et les demandeurs d’asile, mais impliquent aussi des violations de leurs droits fondamentaux.
