The author studies the experience of England and Wales on counteracting domestic violence. The article analyzes how the attitude of the society and the state to this phenomenon has changed, and, instead of being viewed as a commonplace event, it is now recognized as a serious gender violence crime and violation of human rights. Such recognition is based on the position of the UNO expressed in the Istanbul Convention of 2011; joining this Convention made it necessary for the British government to develop a new statute. This Act includes the legislative definition of domestic abuse (this term is an extension of the concept of «domestic violence» introduced at the government level), the introduction of the extraterritorial jurisdiction, more clearly defined methods of victim protection, a provision for a Domestic Abuse Commissioner, etc. The article outlines the path of the UK to the new legislative vision, starting with the development of inter-agency programs and pilot projects of victim assistance and ending with the adoption of legislative acts that criminalize different forms of domestic violence, including forced marriage, «honor» crimes and female genital mutilation. Special attention is paid to a new gender neutral crime - controlling behavior, whose introduction is viewed as unprecedented and controversial. Unlawful control is viewed as actions aimed at suppressing another person, their isolation from people close to them, and depriving them of means necessary for independence, resistance or escape. Coercion, in its turn, is an action or a model of behavior (attack, threat, humiliation, etc.) aimed at inflicting harm, at punishing or terrifying a victim. The author believes that studying British experience of developing inter-agency programs of victim support, including a program that provides information of the criminal past of an intimate partner, and the consistent criminalization of all forms of domestic abuse (even those not connected with physical violence) presents certain interest for Russian lawyers and researchers, and deserves their close attention.
This article provides some insight into foreign states’ regulation of seized property and weaknesses and opportunities for increasing effectiveness of existing regimes. Asset confiscation through proceeds of crime legislation, as well as assets originated from corruption, has taken on a new lease of life over the past few years. The main object of criminal proceeds confiscation laws is to divestiture the financial gain derived from criminal activity and to relinquish it to the state. The author evaluates the legislation and practice in the framework of regulation of seized property in Europe, USA and Australia, and lays stress on social reuse of propriety. In author’s opinion, Italian experience in transferring confiscated assets to local authorities in favour of the society is especially interesting for Russia. It is noted that besides achieving the common goal to seize illicit assets from criminals to the subsequent payment of compensation to victims of crime, to fight against organized crime, terrorism and economic crimes, it is important to create an economically viable asset recovery system, preserving their value in the interests of the state, society and victims, as well as ensuring accountability, transparency and public confidence in the system of asset recovery.

В статье дан ретроспективный анализ корпоративной уголовной ответственности, получившей окончательное оформление в ХХ в. первоначально в решениях судов США и Великобритании. Роль корпораций в жизни государств велика, и велики негативные последствия для общества, экономики и окружающей среды, связанные с такими незаконными деяниями, как мошенничество, взяточничество, легализация незаконных доходов, и иными экономическими преступлениями со стороны корпораций. Признание компании виновной в уголовном порядке может не только разрушить ее репутацию, но и привести к ликвидации и потере десятков тысяч рабочих мест.Цель и задачи исследования -изучение опыта США, Великобритании и Германии по институционализации корпоративной уголовной ответственности и в первую очередь особенностей соглашений об отложенном судебном преследовании и отказе от судебного преследования. Такая практика (получившая в Великобритании закрепление на законодательном уровне) позволяет не преследовать компанию в судебном порядке в обмен на ее отказ от любой прибыли, полученной от незаконной деятельности.Методы исследования: историко-правовой, сравнительно-правовой, формально-юридический. Результаты и краткие выводы: институт корпоративной уголовной ответственности продолжает развиваться и приобретает новые формы. Феномен корпоративной уголовной ответственности заключается в своеобразном сочетании уголовных и гражданско-правовых элементов ответственности. В условиях чрезмерной криминализации различных нарушений, допускаемых корпорациями, и появления все новых составов преступлений этот институт начинает выполнять превентивную функцию, побуждая корпорации к неукоснительному соблюдению корпоративного устава. Государство использует гражданско-правовые механизмы в целях сохранения бизнеса и поддержания равновесия в обществе. Имеется возможность разработки в каждом конкретном случае индивидуальных требований, свойственных ювенальной юстиции, что исключено при обычной процедуре привлечения корпорации в порядке уголовного судопроизводства.Ключевые слова: корпорация, корпоративная уголовная ответственность, соглашение об отложенном судебном преследовании, соглашение об отказе от судебного преследования
