El derecho de acceso a la justicia es considerado como humano, ya que dentro del sistema jurídico que rige al Estado, tal acceso es un presupuesto indispensable y puerta de entrada a la materialización de otros derechos de la misma índole; asimismo, este derecho, al estar reconocido en la Constitución Política de los Estados Unidos Mexicanos, en los diferentes tratados internacionales de los que el Estado Mexicano es parte, y en las diferentes leyes, tales como; la Ley Federal para Prevenir y Eliminar la Discriminación, la Ley General para la Inclusión de las Personas con Discapacidad; constituye un límite a la discriminación de las personas con discapacidad en México. Ahora bien, no puede desconocerse que el contenido de esta prerrogativa es muy amplio y puede variar desde la perspectiva a partir de la cual sea analizada.
