El bullying o acoso escolar continúa representando uno de los principales problemas a los que han de enfrentarse nuestros jóvenes en la actualidad. De hecho, y aunque se está intentando dotar a la Administración, a todos los niveles, de medios suficientes para luchar contra esta problemática, somos testigos de frecuentes casos de flagrante violencia, que nos hacen cuestionarnos si las medidas que se están adoptando son suficientes. Este estudio tiene por objeto el análisis del acoso escolar desde una perspectiva eminentemente procesal, pero sin obviar otros aspectos imprescindibles para entender este fenómeno. Para ello, no solo nos aproximaremos a la regulación del proceso penal de menores y las posibles consecuencias que de él pueden derivarse; sino que también nos fijaremos en aquellos elementos propios de la psicología y que, en cierto modo, pueden ayudarnos a desenmarañar el posible origen de estas situaciones y sus secuelas sobre las víctimas.
A pesar de las reformas a las que se ha visto sometida nuestra Ley de Enjuiciamiento Criminal, desde que entrara en vigor hace más de un siglo, la revisión de la sentencia firme penal representa, en la actualidad, uno de las instituciones procesales en las que más se aprecia, si cabe, la necesidad de una actualización del texto de la Ley. En este sentido, uno de los puntos que merece especial atención es el art. 954 LECrim., que encierra los distintos motivos para incoar la revisión, y cuyo motivo cuarto (art. 954.4º LECrim.) ha venido aplicándose, en algunos casos, con una importante influencia de la casuística, lo que ha dado lugar al reconocimiento tácito de múltiples “submotivos” que el legislador ha tenido a bien incluir en las reformas de la LECrim. en curso. En este sentido, las sentencias del Tribunal Europeo de Derechos Humanos representan uno de los “submotivos” más importantes en sede de revisión, razón por la cual el legislador ha optado por dedicarle un apartado específico en los sucesivos textos de reforma de la LECrim. propuestos. Sin embargo, lejos de dar respuesta a la necesaria regulación de este “submotivo”, el legislador parece haber añadido más complejidad a la regulación ya existente, limitando aún más su aplicación y añadiendo por primera vez, un límite temporal a la revisión de la sentencia firme penal, como puede apreciarse en el Proyecto de Ley para la modificación de la LECrim. de 2015; que parece acercarla, en cierto modo, a la regulación de la revisión de la sentencia firme civil.
La Ley 29/2015, de 30 de julio, de Cooperación Jurídica Internacional en Materia Civil y Mercantil, surgió con la finalidad de dar respuesta a la problemática relativa a los procesos internacionales en estas materias concretas, y ante el vacío legal que se imponía hasta el momento, con independencia de la previsión contenida en la Disposición Final 20ª de la Ley de Enjuiciamiento Civil. Entre las instituciones procesales contenidas en el texto de la ley, aquellas relativas a la litispendencia y las demandas conexas, a las cuales dedicamos este estudio, presentan una posición trascendental en los procedimientos transfronterizos, cuya regulación, en términos generales, pretende dar respuesta a la posible apertura de dos procedimientos con identidad de objeto y sujeto, por parte de un tribunal nacional y otro internacional, y las actuaciones que el juzgador deberá acometer en pro de la seguridad jurídica.
La reforma del Código Penal por la LO 1/2015, de 30 de marzo se ha encargado de incorporar la pena de prisión permanente revisable para algunos delitos especialmente graves de atentado contra la vida o la integridad física (como son, entre otros, el subtipo agravado de asesinato, o el regicidio). Esta medida ha vuelto a poner de relieve debate su posible inconstitucionalidad y la aparente contradicción que supone la aplicación de la prisión permanente en un sistema judicial que, aparentemente, persigue la reinserción del reo en la sociedad. Sin embargo, algunos crímenes recientes (algunos de ellos cometidos por delincuentes reincidentes), mantienen abierto el debate sobre la necesidad de su vigencia, a pesar de las voces discordantes que abogan por su derogación.
