Article 45A paragraph (1) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 states that any person who intentionally and without rights spreads false and misleading news that results in consumer losses in Electronic Transactions shall be punished with imprisonment and/or or fines. The fraud that occurred at One Mall Batam carried out through fake or fictitious electronic transactions cost the victim a total of 30 million rupiah. Purpose: The purpose of this study is to determine the regulation of criminal law against perpetrators of fraud through electronic payments in order to realize legal protection. And to find out the implementation, constraint factors and solutions in preventing and overcoming the rise of fraud in electronic payments. This research method is empirical juridical. Methodology: This research consists of literature study and is also supported by field studies through interviews with respondents. Results: The results of the study indicate that the regulation of criminal law against criminals through electronic payments in realizing legal protection, namely Article 378 of the Criminal Code which regulates special crimes, is also specifically regulated in Article 28 paragraph (1) in conjunction with Article 45A paragraph (1) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions which regulates criminal acts of fraud committed through electronic transactions and is subject to a maximum criminal penalty of 6 (six) years and/or a maximum fine of Rp. 1,000,000,000 ,00 (one billion rupiah). Implementation in preventing and overcoming the rise of fraud in electronic payments is carried out by optimally criminalizing the perpetrators of crimes committed through electronic transactions. Limitations: The constraint factor faced is that there are many types of electronic transactions that cannot be reported directly, making it easier to ensure the results of daily reports. Contribution: The solution is that the victim must be more careful in accepting every payment through an electronic transaction, the victim must have the equipment to verify the proof of the electronic payment. It is recommended for law enforcement officers to optimize the performance of law enforcement for electronic transactions and dismantle tricks or methods applied by perpetrators to prevent other victims, victims to be more careful and thorough in accepting electronic transactions and must ensure first in advance of any payments made. This study aims to analyse impact of foreign ownership to value of non-financial companies listed on Indonesia Stock Exchange.The independent variables consist of Total Foreign Ownership, Foreign Institution Ownership, and Foreign Company Ownership. The variables control consist of size, age, dummy director. Variable dependent is Company Value, using Tobins'Q ratio. The research sample is 72 companies with purposive sampling sampling technique. Period of data is 5 years, from 2014-2018. Data panel regression using as data analysis method. The results showed that Total Foreign Ownership and Foreign Institution Ownership positively and still significantly at level of <15%. While Foreign Company Ownership has a positive but insignificant relationship to the value company. Size, Age, dummy director is not influence to value company. Penelitian ini bertujuan untuk menganalisis pengaruh kepemilikan asing terhadap nilai perusahaan pada perusahaan non-keuangan yang terdaftar di Bursa Efek Indonesia. Variabel independen terdiri dari Kepemilikan Asing Total, Kepemilikan Institusi asing, dan Kepemilikan Perusahaan Asing. Variabel kontrol terdiri dari Ukuran perusahaan, Umur Perusahaan, dan dummy Direksi. Variabel dependen adalah Nilai Perusahaan, diukur dengan Tobin’s Q. Sampel penelitian sebanyak 72 perusahaan yang ditentukan dengan teknik purposive sampling. Periode data 5 tahun, yakni dari 2014-2018. Metode analisis data yang digunakan adalah regresi data panel. Hasil penelitian menunjukan Kepemilikan Asing Total dan Kepemilikan Institusi Asing berpengaruh positif dan masih signifikan pada tingkat < 15% terhadap Nilai Perusahaan. Sementara Kepemilikan Perusahaan Asing memiliki pangaruh positif tetapi tidak signifikan terhadap Nilai Perusahaan. Ukuran Perusahaan, Umur Perusahaan, dan dummy direksi tidak berpengaruh terhadap Nilai Perusahaan.
This research aims to examine the ownership on Islamic economic and the ownership stock effect on firm performance and the moderating influence of independent commissioner on the connection between ownership stock and firm performance. Indicator of ownership stock studied was the ownership stock of the president director in the company. The firm performance studied by the calculation of Price per Earning Ratio. Then, the intended independent commissioners are the percentage of independent commissioners who are on the company's board of commissioners.This research uses qualitaitive method based on Islamic economic literature and quantitative methods basedon secondary data. Secondary data in this research are the financial report from firms that take the floor on Indonesia Stock Exchange (IDX). This investigation uses a population that is listed firms on Indonesian Sharia Stock Index (ISSI). Subsequently, the sample is filtered using purposive sampling techniques with the criteria of listed firms on Indonesia Stock Exchange and has the data needed in this investigation. As a result, the samples obtained were 296 companies. This research uses regression analysis with individual parameter significant test (t-test).Hypothesis testing results indicate that Sharia company ownershipis in accordance with Islamic economic perspective studies, and ownership stock with the indicator of ownership of the president director has an impact on firm performance with Price per Earning Ratio’s indicator, and independent commissioners based on the proportion of independent commissioners on the board of commissioners moderate the correlation between ownership stock and firm performance. The purpose of this research is to examine the effect of Temporary Syirkah Fund and Operational Efficiency on Sharia Bank Profitability. Indicator of Syirkah Temporary Fund under study is the amount of public savings funds in Sharia Bank with Mudharabah contract. Operating Efficiency uses the ratio indicator of Operating Expense on Operating Revenue (BOPO). Then, Sharia Bank Profitability is the calculation of Return On Asset Ratio (ROA). The research is conducted by quantitative methods using secondary data. The secondary data comes from quarterly reports from Sharia Bank in Indonesia. The population of this research is Sharia Bank in Indonesia, and then the sample is taken based on purposive sampling with the criteria of five Sharia Bank with the largest assets, to obtain the sample as much as 60 quarterly report of Sharia Bank. This study used regression analysis with significant test of simultaneous parameter (F - test) and significant test of individual parameter (t - test). The result of the hypothesis test indicates that simultaneously and partially Temporary Syirkah Fund and Operational Efficiency affect to Sharia Bank Profitability in Indonesia, calculated by ROA Ratio, and Operating Efficiency have bigger influence to Sharia Bank Profitability compared to Temporary Syirkah Fund.
Waqf is one of the sources of Nation's income that can empower the sharia economy. The Implementation of waqf cannot be separated from the supervision of the Indonesian Waqf Board. Indonesian Waqf Board supervises at the provincial level as an independent institution tasked with empowering productive waqf. In this study, the supervisory process carried out by the Indonesian Waqf Board in South Kalimantan applies the empowerment of productive waqf by the Indonesian Waqf Board of South Kalimantan to the development of the sharia economy. This study aimed to determine how to implement the empowerment model applied by the Indonesian Waqf Board to the sharia economy. This research is a descriptive study with a sociological and normative approach. Data collection techniques through observation, interviews, documentation, and triangulation with the determination of informants through purposive snowball sampling. The results showed that from these results the implementation of (1) the waqf model for building construction in building facilities and infrastructure, and (2) the waqf model for business development covering agriculture, animal husbandry, and business units. The two models are then linked to management, including investment management and productive waqf distribution management. The management of the Indonesian Waqf Board in South Kalimantan implements the empowerment of Human Resources with the supervision of nazhir based on waqf law, sharia economic system, and waqf administration or entrepreneurship. The managerial process is inseparable from the leadership factor. Through direct supervision by South Kalimantan BWI staff and the Ministry of Religion, control is carried out to oversee productive waqf assets.
