Indonesia's bitter experience of the embargo became a hard slap and a reminder of the importance of the National Defense Industry in meeting the needs of the TNI's defense equipment and encouraging the quality of the TNI's performance in carrying out the territorial defense of the Republic of Indonesia. Over time the development of the National Defense Industry continues to grow and is supported by regulations at the level of the Law, namely Law no. 16 of 2012 concerning the Defense Industry in realizing the Independence of the National Defense Industry. However, over time the implementation of Law no. 16 of 2012 does not work properly, challenges and problems arise, there are two problems in the National Defense Industry, namely Research and Development (R&D) and Defense Clustering. In this paper, a deeper review of the complex defense industry uses the research method, namely normative juridical research with two approaches including the statute approach and the conceptual approach. The results of the research in this paper carry the Core Indonesia Military-Industrial Complex which supports the strengthening of Research by initiating the Concept of Feedback and Clustering of the Defense Industry by forming 7 Defense Industry Clusters which include Raw Material Industry, Production Industry, Assembly Industry, Production, Support Industry (Components, Spare Parts), Electronic Industry, Maintenance.
This paper discusses the legal development policy in the Government's Procurement of Goods and Services and to reveal the legal development sector in the regulation as well as a comparison of the Government's Procurement of Goods and Services policy between Indonesia and the Philippines. The method used in this paper is normative juridical with a statutory study approach (statue apporouch). The results of this study indicate that the direction of the government's procurement of goods and services policy is the achievement of the output and outcome of government agencies, economic improvement for both business actors and the community through economic equity and sustainable development, as well as comparisons related to government procurement of goods and services in Indonesia during the New Order era with integrity. The State Budget, however, is entering the decentralized Reform period and there are new regulations in the Government's Procurement of Goods and Services with the formation of an auction committee at each Office/Work Unit/Project Leader/Project Section. In the Philippines, it is formed in the Government Procurement Reform Act which is the basis for the regulation of Government Procurement of Goods and Services in the Philippines.
Pemindahan Ibu Kota Negara (selanjutnya disingkat IKN) Republik Indonesia berpengaruh terhadap seluruh aspek kehidupan masyarakat adat di wilayah IKN Nusantara, khususnya bidang pertanahan. Tujuan dari penelitian ini adalah menelaah bagaimana implikasi pembangunan IKN Nusantara terhadap bidang tanah masyarakat hukum adat serta bagaimana solusi efektif dalam melindungi hak masyarakat hukum adat. Pembahasan karya tulis ini, yaitu mengenai implikasi dan tantangan yang akan dihadapi masyarakat hukum adat terhadap pembangunan IKN Nusantara dan upaya perlindungan hukum preventif terhadap masyarakat hukum adat di wilayah IKN Nusantara. Metode penelitian yang digunakan adalah yuridis normatif dengan teknik pengumpulan data melalui studi kepustakaan. Bahan yang dikumpulkan berupa bahan hukum primer dan bahan hukum sekunder. Adapun simpulan berdasarkan jabaran pembahasan adalah masyarakat hukum adat di wilayah IKN mempunyai problematika setifikat tanah, permasalahan degradasi pemilikan tanah, konsensi tanah, dan kebijakan yang saling tumpang tindih. Perlindungan hukum preventif yang dilakukan, yaitu mempertahankan living law, menerbitkan aturan Rencana Tata Ruang, dan mengadakan pendaftaran tanah bagi masyarakat yang belum memiliki sertifikat. Adapun rekomendasi yang ditawarkan adalah perlu dimasukkan muatan mekanisme pengadaan tanah masyarakat adat di wilayah IKN Nusantara dalam aturan mengenai Rencana Tata Ruang Kawasan Strategis Nasional dan diwujudkan dalam bentuk Perpres serta menghormati living law yang selama ini masih dipegang oleh masyarakat hukum adat.
Foreign investment is one of the crucial instruments for a country in promoting economic growth for the sake of creating public welfare. Indonesia as a country with abundant economic potential, requires foreign investors to solve problems, especially related to sustainable development and suppress the high unemployment rate. Legal reform in increasing the realization of foreign investment entering Indonesia is realized through the Omnibus Law in the Job Creation Act to create a good and healthy investment climate. The presence of Covid-19 has caused the country's economy to experience a significant decline. The presence of the Job Creation Act in accelerating foreign investment into Indonesia is expected to encourage the strengthening of the national economy after the Covid-19 pandemic. However, there are problems in its implementation caused by the guarantee of legal certainty in running business activities and overlapping regulations in business licensing. The research method used is normative legal research. This study uses the Statute approach. The technique of tracing legal materials uses library research techniques, and analysis of studies using qualitative analysis. The results of this study indicate that the Government has made maximum efforts by issuing various regulations or policies to revive the investment climate in Indonesia so that the country's economic growth can increase, and is able to provide legal certainty in doing business in Indonesia.
The profession of arbitrator in Indonesia is a profession that has bright prospects for the present and the future. Based on Article 1 point 7 of Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, the arbitrator profession is one or more persons who are chosen by the parties to the dispute or appointed by the District Court or by the arbitration institution, to give a decision regarding a particular dispute. which has been resolved by arbitration. An absolute requirement for an arbitrator is a professional, this is closely related to the ethics of the legal profession in carrying out its duties and authorities. The professional position of the Arbitrator is as a private party who is given rights and obligations, authorities and responsibilities by the state (AAPS Law No. 30 of 1999). In this paper, the author uses the juridical-normative method with a statute approximation approach or a study of legislation. This paper reviews more deeply about the Arbitrator Profession within the scope of the Legal Profession. Profesi Arbiter di Indonesia menjadi profesi yang mempunyai prospek cerah untuk masa sekarang hingga masa mendatang. Berdasarkan Pasal 1 angka 7 UU No.30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa, profesi arbiter merupakan seorang atau lebih yang lebih yang dipilih oleh para pihak yang bersengketa atau yang ditunjuk oleh Pengadilan Negeri atau oleh lembaga arbitrase, untuk memberikan putusan mengenai sengketa tertentu yang diserahkan penyelesaiannya melalui arbitrase. Syarat mutlak dimiliki seorang arbiter adalah profesional, hal ini berkaitan erat dalam etika profesi hukum dalam melaksanakan tugas dan wewenangnya. Kedudukan profesi Arbiter adalah sebagai pihak swasta yang diberikan hak dan kewajiban, wewenang dan tanggung jawab oleh negara (UU AAPS). Dalam tulisan ini penulis menggunakan metode yuridis-normatif dengan pendekatan statute approch atau studi perundang-undangan. Tulisan ini mengulas lebih dalam tentang Profesi Arbiter dalam ruang lingkup Profesi Hukum.
