The COVID-19 pandemic has significantly impacted the health sector and the economy. As an affected country, the Indonesian government has issued many policies to prevent and control the Covid-19 virus. However, substantial problems arise, with the absence of compliance from some people in certain areas, such as Bandar Lampung City, Lampung Province. Although the local government issued Regional Regulation Number 3 of 2020 concerning Adaptation of New Habits in the Prevention and Control of Corona Virus Disease 2019 to regulate the community's obligations in implementing the 3M Health Protocol in public spaces, the main problem in this study is the people of Lampung Province's lack of discipline in implementing the 3M Health Protocol and the dynamics of implementing e-Court during the pandemic. Therefore, there needs to be a review regarding the effectiveness of implementing the 3M Health Protocol to prevent the spread of Covid-19 in Bandar Lampung, as well as the application of e-Court in the perspective of other laws and regulations. The research method used in this study is empirical law research, by taking a problem-based approach to a behavioral approach supported by primary data sourced from data sources. The implementation of the 3M health protocol through Regional Regulation Number 3 of 2020 shows quite effective results in its application in public spaces based on a survey of 86 respondents from the people of Bandar Lampung City. It was recorded that 83.5% of 86 respondents stated that public services at the Court had been carried out online, while 16.5% stated that they were done online through e-Court but limited. However, when taken as a whole, the implementation of health protocols and e-Courts as part of the effort to prevent the spread of Covid-19 is relatively good; it's just that certain obstacles must be evaluated.
Permasalahan dalam kegiatan ini adalah: 1) Pada umumnya tingkat pengetahuan dan pemahaman hukum para siswa terhadap Undang Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan masih rendah. 2) Tingkat kedisiplinan atau kepatuhan para siswa terhadap tertib lalu lintas di jalan raya masih perlu untuk ditingkatkan, mengingat masih sering ditemukan adanya pelanggaran lalu lintas. 3) Pada umumnya para siswa belum sepenuhnya sadar akan manfaat dan pentingnya mematuhi peraturan lalu lintas untuk keselamatan di jalan. Solusi untuk mengatasi masalah tersebut adalah dengan melakukan proses edukasi dan pengenalan kaidah-kaidah hukum khususnya tentang hukum lalu lintas kepada para siswa dalam bentuk sosialisasi atau penyuluhan hukum. Kegiatan penyuluhan hukum ini cukup berhasil ditandai dengan keaktifan peserta, baik dalam mengikuti dan menyimak penyajian materi maupun dalam kesempatan tanya jawab atau diskusi. Para peserta juga ada peningkatan pengetahuan dan pemahaman tentang hukum yang mengatur mengenai ketertiban berlalu lintas. Hal ini ditunjukkan dengan hasil evaluasi dari 49,50 pada evaluasi awal menjadi 65,7 pada evaluasi akhir. Ke depan diperlukan adanya tindak lanjut serta kontinuitas dari kegiatan tersebut, baik penyuluhan hukum tentang lalu lintas maupun bidang-bidang hukum lain seperti narkoba, kenakalan remaja, atau norma-norma sosial lainnya.
<p align="center"><strong>Abstract</strong></p><p><em>Nursing personnel is one of the most important actor in helping doctor to perform medical acts. Medical acts, performed by doctor in hospital, are generally known as therapeutic transaction or healing agreement. parties who are involved directly in therapeutic transaction are doctor and patient. Therefore nursing personnel as doctor helper in that transaction shall not be positioned as a party in the agreement. Nursing personnel in this context holds the position as participant in the agreement, not as “contractan”. Within this context, nursing personnel can’t be sued by the reason of default. Legal standing of nursing personnel in helping doctor to perform therapeutic transaction, within medical law literature, is legally known as performing dependent function.</em></p><p><strong><em>Keyword: </em></strong><em>legal standing, nursing personnel, and therapeutic transaction.</em></p><p align="center"><strong>Abstrak</strong></p><p>Tenaga keperawatan adalah salah satu tenaga kesehatan yang paling utama dalam membantu dokter untuk melakukan tindakan medik. Tindakan medik yang dilakukan oleh dokter di rumah sakit, dalam literatur hukum kesehatan sering disebut sebagai transaksi terapeutik atau perjanjian penyembuhan. Pihak-pihak yang terlibat secara langsung dalam transaksi terapeutik adalah dokter dan pasien. Oleh karena itu, tenaga keperawatan yang difungsikan sebagai pembantu dokter dalam transaksi tersebut kedudukannya bukanlah sebagai pihak dalam perjanjian. Tenaga keperawatan dalam konteks ini berkedudukan sebagai peserta dalam perjanjian bukan sebagai “contractan”. Dengan demikian tenaga keperawatan tidak dapat digugat berdasarkan wanprestasi. Kedudukan tenaga keperawatan dalam membantu dokter melakukan transaksi terapeutik, dalam literatur hukum medik lebih dikenal sebagai menjalankan fungsi <em>dependent</em>.</p><p><strong>Kata Kunci: </strong>kedudukan hukum, transaksi terapeutik</p>
During the Covid-19 pandemic, online health services through applications or telemedicine have increased yearly. Many parties are involved in telemedicine to spread the confidentiality of information and patient privacy to various parties. Even though regulations and guidelines regarding telemedicine's implementation during the Covid-19 pandemic are established, personal data leakage still occurs. The problem discussed in this research is: How was telemedicine implemented in Indonesia during the Covid-19 pandemic? And how is the regulation of privacy rights protection for patients who use telemedicine in Indonesia? This research uses a descriptive normative research method with a qualitative approach. The research results show various problems in Indonesia's telemedicine implementation during the Covid-19 pandemic, especially problems related to data protection regulation for telemedicine patients. Based on the author's analysis, no regulations regulate strict sanctions when the patient's data or medical records are not kept confidential. There is no explicit provision that threatens anyone who misuses the patient's data. Thus, it is necessary to have special regulations governing the protection of patients' privacy rights in the use of telemedicine in Indonesia, and Indonesian legislators need to continue the legislative process of the Personal Data Protection Bill.
Patient privacy is a right guaranteed by law that allows patient to conceal their medical records. However, this rights only applies in normal conditions and does not apply during a pandemic. It is often being misunderstood that broad society decided to close their medical records during this pandemic. The closing of the medical record will potentially cause the difficulty in detecting the virus’ transmission. Moreover, the status of a patient recognized as pandemic-suspected is often being ignored by their family and ultimately brought home assuming that their family is in good condition. This fact has immense potential to generate a wider spread of the pandemic virus. According to the previous subject, the study will further discuss the Indonesian regulations concerning the protection of patient confidentiality during the pandemic and the legal status for those responsible for taking the pandemic-suspected patient in force. This study hopefully will be contributing to the prevention of such actions mentioned above. This study uses a normative legal approach with secondary data research. The study results show that the broad society merely understands that the confidentiality of patient privacy only applies in normal circumstances and does not apply during the pandemic situation. Moreover, the forced withdrawal of pandemic-suspected patients occurs due to society's general prejudice towards the suspected patient. Therefore, this study argues that social awareness regarding the protection of patient confidentiality is necessary to increase social knowledge about patients' rights.
