ĮvadasReikia pripažinti, kad, teikiant sveikatos priežiūros paslaugas, kaip ir kiekvienoje asmens veikloje, nėra išvengiama klaidų. Klaidų ne visada išvengiama net ir atsižvelgiant į didelę medicinos pažangą. Iliustruojant šį teiginį reikia pažymėti, kad 1960 metais A. A. Klasso 1 , o vėliau 2011 metais ir B. A. Kochas akcentavo paradoksalią situaciją, kai esant nepaneigiamai medicinos mokslo pažangai, didėjant tikimybei, kad pacientai bus išgydyti ir jiems suteiktos tinkamos sveikatos priežiūros paslaugos, vis dėlto klaidų ir toliau pasitaiko, gausėja ieškinių dėl netinkamai teiktų sveikatos priežiūros paslaugų 2 . Be to, nuo XX amžiaus pabaigos medicina tapo savo pačios sėkmės auka, kai gyventojų domėjimasis jos pažanga verčia tikėtis paties geriausio gydymo rezultato, o sveikatos priežiūros specialistų klaidos, nerūpestingas elgesys nėra toleruojami 3 . Taigi tinkamo sveikatos priežiūros paslaugų teikimo, jas teikiant padarytos žalos atlyginimo klausimai išlieka aktualūs, nepaisant medicinos pažangos.Ne išimtis yra ir Lietuva, kur paskutiniu metu vis garsiau ir aršiau kyla diskusijų dėl galimo netinkamo gydymo paslaugų teikimo, dėl jų metu padarytos žalos ir kad Lietuvos teisinė sistema, tiek jos 1 KLASS, A.
This article examines the possibilities to recognise the compensation of the child’s maintenance cost in the wrongful birth cases. Both the foreign legal doctrine and case-law of foreign countries reveal different approaches to the possibility to allow such compensation. In such a context, taking into account the legal regulation, the perspectives of solution of this question in Lithuania are analysed.
This article examines the significance and the content of the principle of judicial independence and its assurance based on Article 267 of the Treaty on the Functioning of the European Union and Article 19 (1) of the Treaty on European Union. The interaction between these provisions is analysed in the context of the development of the case-law of the Court of Justice of the European Union.
ĮvadasGydytojams ir kitiems sveikatos priežiūros specialistams tenka ypač svarbus vaidmuo užtikrinant žmo-gaus teisę į gyvybę, sveikatą, tačiau jų veikloje nėra išvengiama klaidų, kurios lemia ypač skaudžius padarinius. Pavyzdžiui, 1999 metais Jungtinių Amerikos Valstijų medicinos instituto atliktas tyrimas "Klysti yra žmogiška: kuriant saugesnę sveikatos sistemą" atskleidė, kad nuo 40 000 iki 98 000 asmenų kasmet Jungtinėse Amerikos Valstijose miršta dėl medicinos praktikos klaidų 1 . Panašius faktus liudija ir vėlesni Harvardo universiteto atlikti tyrimai 2 . 2008 m. Europos Tarybos valstybių narių susitikime buvo pabrėžta, kad daugelyje Europos valstybių vis labiau ryškėja susirūpinimas dėl netinkamų sveikatos priežiūros paslaugų teikimo, jų metu patirtos žalos atlyginimo tvarkos sudėtingumo 3 . The article deals with the charge of irrelevance levelled against D. Lewis’s modal realism, notably known as a reductionist account of modality. The charge of irrelevance is apparently one of the most popular objections to modal realism though it often seems that the debate surrounding this charge is not very fruitful since in this context it is common to appeal, implicitly or explicitly, to different criteria for theory choice. As a result, the article deals with the problem in a slightly different manner. The article addresses arguments aimed to show that, contrary to what is often stated, modal realism does not violate our pre-theoretical intuitions, as well as arguments aimed to respond to the charge of irrelevance without appealing to criteria for theory choice at all but providing different reasons instead. However, the aim of this article is to show that all these arguments are rather unconvincing.
