Gender-separate education, understood as a pedagogical model that provides separate schooling for boys and girls, has been subject to legal and public scrutiny for the past thirty years. Nonetheless, it has not been until 2018 that this educational option was put into the spotlight, especially regarding its constitutionality and compatibility with arts. 1.1, 9.2 and 14 of the Spanish Constitution, which constitute a manifestation of the principles of equality and non-discrimination, while at the same time trying to balance it with art. 27 of said constitutional text, with respect to the right to education and freedom to choose and create educational centers. Against this backdrop, the present paper reviews the constitutional state of play and makes further reflections from a rights-based perspective and taking into account the cultural pluralism that characterizes contemporary societies.
En los últimos años, la noción de «identidad constitucional» se ha convertido en un recurso político-constitucional popular a la vez que en un concepto jurídico indeterminado. Resulta difícil tratar de definir la noción enigmática de «identidad constitucional» y su ámbito de aplicación, debido a la falta de consenso entre la doctrina académica, por lo que el presente artículo trata de proporcionar una definición amplia o integradora a través de una serie criterios e instrumentos para su identificación y aproximación jurídica. Con tal premisa, se efectúa un análisis de lo que constituye tanto la identidad constitucional nacional como europea, con especial interés en la identidad constitucional española y la de la Unión Europea. Además, el presente estudio trata de abordar los retos para la integración europea como resultado del conflicto inherente entre la primacía del Derecho de la Unión Europea y el contralímite que consagra en su artículo 4.2 TUE sobre el respeto a la identidad nacional de los Estados que la componen. Finalmente, la autora concluye con unas propuestas de mejora y acercamiento a los problemas planteados, a través de un dialogo activo, constructivo y continuado, impulsado por el procedimiento prejudicial europeo.
A pesar de la extendida percepción sobre la necesidad de renovar las formas de facilitar la adquisición de contenidos, el papel del profesor en el proceso de enseñanza-aprendizaje y el desarrollo de competencias en la educación superior, existen todavía disciplinas que presentan dificultades de adaptación a los nuevos modelos de innovación docente. La titulación de Derecho, en algunos aspectos, es un claro ejemplo, pues todavía prevalecen las clases magistrales y la memorización. Por todo lo anterior, sobre todo cuando se trata de asignaturas de carácter introductorio, es de gran importancia garantizar una buena comprensión del lenguaje de especialidad (en nuestro caso el lenguaje jurídico) que acompañará al alumnado a lo largo de la titulación y durante toda su carrera profesional. Esta necesidad resulta, si cabe, aún más acuciante en lo que a asignaturas con docencia en inglés se refiere, pues a la dificultad intrínseca de la jerga jurídica, se añade la dificultad de la equivalencia entre sistemas de Derecho Común y Derecho Civil (en nuestro caso, el sistema sui generis de la Unión Europea y su terminología jurídico-administrativa propia). La presente comunicación se centra en el uso de crucigramas como metodología docente en el aula y como estrategia de aprendizaje en materia de inglés jurídico, a partir de una experiencia piloto en el primer curso del Grado en Derecho en el grupo de Alto Rendimiento Académico (ARA) con docencia en inglés. Así, se pretende señalar las ventajas probadas del crucigrama, acercando a los docentes de asignaturas introductorias de cualquier disciplina técnica (sobre todo las que se enseñan en inglés) a una herramienta de motivación y de generación de aprendizaje significativo.

En tiempos digitales, los derechos más personalísimos,dispuestos bajo el paraguas de la dignidad y la libertad, requierenun cierto poder de control, una autodeterminación y autonomía informativas. La postura europea ha sido regular el conocido derecho al olvido ante la elaboraciónautomática de perfiles, la compilación y la presentación descontextualizada que las NTIC generan y hacen universalmente accesible en el mundo enlínea. Debido a las críticas de su regulación europea y española (2016-2018), elpresente artículo analiza, desde un enfoque basado en los derechos fundamentales,la justificación ontológica de este mecanismo de control, para protegerla dignidad humana contra la resurrección perjudicial que producen un clic instantáneo y una memoria digital.
